Wyjawienie majątku dłużnika w postępowaniu egzekucyjnym w prawie hiszpańskim, włoskim i niemieckim

Celem prezentowanego opracowania jest omówienie instytucji w egzekucji sądowej – wyjawienia majątku dłużnika w prawie hiszpańskim, włoskim i niemieckim. Charakter prawny tego środka jest tożsamy w kontynentalnych systemach prawnych. Celem wyjawienia majątku jest bowiem uzyskanie wiedzy o mieniu dłużnika, z którego można prowadzić skuteczną egzekucję. Autor opracowania przeanalizował przepisy hiszpańskiego kodeksu postępowania cywilnego (Ley de Enjuiciamiento Civil) – art. 589, 590, włoski kodeks (Codice di Procedura Civile) – art. 492, 492-bis i na koniec kodeks niemiecki (Zivilprozessordnung) – § 802a i nn. Dla kontrastu rozważań, jako sposób odnalezienia majątku dłużnika, autor w zakończeniu opracowania przywołał również przykład z systemu common law, rozwiązanie prawne określone jako Mareva Injunction (Freezing Injunction).

The purpose of this article is to discuss the regulation of the debtor to disclose his assets in Spanish, Italian and German law. The nature of this measure is the same in the continental legal systems. The aim to disclosure the assets is to obtain knowledge of the debtor’s property which can be carried out effective enforcement. The Author analyzed the regulations of the Spanish Code of Civil Procedure (Ley de Enjuiciamiento Civil) – art. 589, 590, the Italian Code (Codice di Procedura Civile) – art. 492, 492-bis and in the end, the German Code (Zivilprozessordnung) – § 802a ff. By contrast, as a way to find property of the debtor, the Author recalled in the end also an example of the common law system, which is used as a remedy called Mareva Injunction (Freezing Injunction).
