The paper presents the consequences of the introduction of the Act on Ensuring Accessibility for Persons with Special Needs to the third sector entities. Depending on sources of financing, they have been subject to a more or less wide range of duties. The article describes conditions that determine if and to what degree a non-governmental organization will be bound by the provisions of the act. Given the realities of the operations in the third sector, especially financial ones, it may turn out that in practice those conditions cannot be met. The author has also reflected on the importance of subjecting the third sector organizations to these duties and considering some of them “public entities” for positioning such organizations on a map of public institutions.

Artykuł koncentruje się na skutkach, z jakimi wiąże się wprowadzenie Ustawy o zapewnianiu dostępności osobom ze szczególnymi potrzebami dla podmiotów trzeciego sektora. W zależności od źródeł finansowania zostały one objęte mniejszym lub większym zakresem obowiązków. Przedmiotem rozważań jest opis warunków, od których zależy to, czy i w jakim stopniu organizacja pozarządowa będzie związana przepisami ustawy. Wypełnienie tych obowiązków może okazać się w praktyce niemożliwe, biorąc pod uwagę realia działania w trzecim sektorze – przede wszystkim finansowe. Refleksji poddano również to, jakie znaczenie dla usytuowania podmiotów trzeciego sektora na mapie instytucji publicznych ma objęcie ich takimi obowiązkami oraz zaliczenie niektórych z nich w poczet „podmiotów publicznych”.
