Private international law continues to play an important role in legal relations between entities from EU Member States. In a situation of progressive integration, where substantive and procedural private laws of the Member States are not unified, private international law is necessary to the functioning of an area without internal borders. Without doubt, contemporary private international law is subject to enormous transformations under the influence of EU law. First of all, this branch of law, which is traditionally the domain of national law, becomes EU law, so autonomous national regulations become less important, and the Member States transfer their competence to regulate private international law to EU institutions. As it is in other areas of law, including those where Member States retain their authority to autonomously regulate private international law, EU law affects such regulations by introducing new solutions that Member States subsequently incorporate in their internal regulations.

One of the political goals of the EU in broad is the absorption of all European continent state in a sort of United States of Europe. Nowadays the EU counts 28 states and the perspective of enlargement is not stopped by the current economic crisis. The current situation after the just completed pro-EU revolution in Ukraine and the implementation of strong economic link with former USSR Transcaucasian Republics (Georgia, Armenia and Azerbaijan) may suggest the final number of state in the EU. Many people believe that the United States of Europe puzzle is nearly full defined … but a new kind of EU enlargement may change the situation. This paper will focus only in one question. “Is an EU Member state secessionist territory automatically in the EU after archiving its Independence or have to reapply?” To answer to this question I will analyses the possible past experiences in secessionist territory getting membership in international organization like UN. The Vienna Convention on Succession of States in Respect of Treaties is a good material to use in case of succession but the fact that is not in force and not signed by the greatest part of EU member state make it only advisory and not binding.

Zwiększenie interakcji między prawem Unii Europejskiej a ustawodawstwem państw członkowskich (w tym prawo regionalne) doprowadziło do nowych paradoksów związanych z wielopoziomowymi systemami prawnymi, które łączą różne poziomy normatywne. Tradycyjne podmioty narodowe czują się zagrożone przez struktury ponadnarodowe i narastającą decentralizację, które powodują organizacyjne kryzysy. Harmonizacja legislacji w Europie, która jest o wiele szersza, niż mogłoby się wydawać, nie została zaakceptowana bez niechęci, spowodowanej przez trudności w komunikacji społecznej i politycznej, we wszystkich państwach członkowskich. Ponadto nowe paradygmaty skonfrontowały się z autonomicznymi pojęciami wytwarzanymi w procesie integracji europejskiej, co przyczyniło się także do kryzysu doktryny prawnej.

The multilevel legal instruments protection equality in the complex legal systems have a differentiated structure, according with the level in which they operate. In international law we have the Pacts and the Convention within United Nations and, within the Council of Europe, we have the European Convention of Human Rights. In the legal order of European Union we should distinguish between the norms of “hard law” (Treaties, regulations, directives, decisions, jurisprudence...) and the ones of “soft law” (mainly recommendations and programs). In internal law, we ought to distinguish between unitary systems and the composed or complex ones.
