Przesłuchanie świadka w procesie karnym w trybie art. 185e Kodeksu postępowania karnego

The article analyses the new special procedure for hearing witnesses in criminal proceedings under Article 185e of the Polish Code of Criminal Procedure, based on the model in pre-trial investigation. The provision discussed is part of a wide-ranging amendment of the so-called anti-violence act 2.0. The authors consider the currently applicable catalogue of activities that the courts undertake in pre-trial investigation, and subsequently analyse the special hearing procedure under Article 185e of the Code of Criminal Procedure, which is a new procedure for the courts in pre-trial investigation. The authors of this article believe this amendment should be evaluated as positive, because it makes the justice system more friendly to the excluded. Furthermore, this is a starter for a discussion on changing the judicial review model in pre-trial investigation and specifying the role of authorities taking part at this stage of proceedings.

Przedmiotem artykułu jest analiza nowego specjalnego trybu przesłuchania w procesie karnym w myśl art. 185e Kodeksu postępowania karnego na tle modelu postępowania przygotowawczego. Omawiany przepis jest częścią dużej nowelizacji, tzw. ustawy antyprzemocowej 2.0. Autorzy dokonują rozważań na temat dotychczasowego katalogu czynności sądu w postępowaniu przygotowawczym, następnie analizują specjalny tryb przesłuchania z art. 185e k.p.k., który jest nową czynnością sądu w postępowaniu przygotowawczym. Zdaniem autorów nowelizację tę należy ocenić pozytywnie, ponieważ czyni ona wymiar sprawiedliwości przyjazny osobom wykluczonym. Co więcej, jest to przyczynek do dyskusji nad zmianą modelu sądowej kontroli postępowania przygotowawczego i określenia roli organów biorących udział w tym stadium postępowania.
