The national cybersecurity system is formed of a number of public entities, including executive agencies with legal personality as entities of the public finance sector. The executive agency could implement cybersecurity tasks important to the functioning of the state and its institutions. Through this legal organisational form, it would be possible to shape the development of new technologies that could then serve a digital society or digital state, including the protection of ICT systems for communication, as well as the provision of digital services and key services. Due to the widespread activity in cyberspace, it is necessary to have entities in place to protect its users. Such an entity could have the form of a cyber agency, working with other institutions (public and private), that is competent for cybersecurity

W artykule podjęto problematykę form organizacyjno-prawnych w sektorze finansów publicznych. Mając na uwadze zróżnicowane zasady ich tworzenia oraz finansowania zadań publicznych, za cel pracy przyjęto analizę zasad funkcjonowania form organizacyjno-prawnych działających w warunkach quasi-rynkowych. W artykule zaprezentowano rozważania o charakterze teoretycznym dotyczące kryteriów wyboru formy organizacyjno-prawnej finansowania zadań publicznych oraz podstaw prawnych funkcjonowania agencji wykonawczych i instytucji gospodarki budżetowej. W części empirycznej pracy analizie poddano wyniki finansowe omawianych form w latach 2011–2016 w kontekście regulacji prawnych. W opracowaniu zastosowano metodę porównawczej analizy opisowej. Przeprowadzone badania umożliwiły ocenę efektywności działania wybranych form organizacyjno-prawnych w świetle osiąganych wyników finansowych, a także wskazanie rozbieżności pomiędzy regulacjami ustawowymi i ich funkcjonowaniem w praktyce.

The article looks at organisational and legal forms in the public finance sector. Bearing in mind the diverse rules of their creation and financing of public tasks, the main goal of the work was to analyse the principles of functioning of forms of financing public tasks operating under quasi-market conditions. The structure of the study reflects its specific objectives. It includes theoretical considerations regarding the criteria for choosing the organisational and legal form of financing public tasks and the legal basis for the functioning of executive agencies and budgetary authorities. In the empirical part of the work, the financial results of the forms discussed were analysed for the years 2011–2016 against the background of legal regulations. For methodology, the study uses comparative descriptive analysis. The research led to conclusions and observations that provide the basis for assessing the effectiveness of the forms of financing in the light of the financial results achieved, as well as for identifying discrepancies between statutory regulations and how they function.

The article is devoted to the identification and discussion of the challenges faced by the administration in respect to integration processes, the Europeanisation of public administration, but also the ever-stronger dynamics of the processes of globalization. In the light of this problem, the analysis covered, inter alia, models of the impact of European law on national law. The areas of the Europeanisation process were also indicated, showing the Europeanisation of public administration tasks in this regard. The considerations also concern the issue of agencies that are of interest to the so-called “Indirect administration”.
