L’articolo si propone di rispondere alla domanda in che misura le regolazioni dell’UE relative agli appalti pubblici permettono di applicare i criteri di aggiudicazione, i quali consentirebbero la fornitura di alimenti prodotti localmente e da filiere corte. La direttiva 2014/24/UE sugli appalti pubblici prevede di includere i criteri ambientali, qualitativi oppure sociali al fine di garantire l’offerta economicamente più vantaggiosa in termini di miglior rapporto qualità-prezzo. Tenere conto di questi aspetti è decisivo per gli appalti “verdi” o “sostenibili”. Tra gli aspetti qualitativi e ambientali è possibile definire i criteri quali i prodotti di filiera corta o di provenienza diretta, grazie ai quali i prodotti alimentari locali diventano oggetto di appalti pubblici “verdi” e “sostenibili”.

The aim of these considerations is to answer the question to what extent EU public procurement regulations allow contract award criteria that would enable the supply of food locally produced or sourced from short supply chains. Directive 2014/24/EU on public procurement provides for the use of criteria that include environmental, quality or social aspects in order to ensure the most cost-effective tenders. The inclusion of these aspects determines “green” or “sustainable” procurements. Among the qualitative and environmental aspects, criteria such as products from short chains or direct supplies may be specified, allowing local food to be the subject of “green” and “sustainable” public procurement.

Celem rozważań jest odpowiedź na pytanie, na ile unijne regulacje zamówień publicznych pozwalają na zastosowanie kryteriów udzielenia zamówienia, które umożliwiałyby dostawy żywności lokalnie wytworzonej lub z krótkich łańcuchów dostaw. Dyrektywa 2014/24/UE w sprawie zamówień publicznych przewiduje stosowanie w zamówieniach kryteriów obejmujących aspekty środowiskowe, jakościowe lub społeczne w celu zapewnienia najkorzystniejszej ekonomicznie oferty pod względem relacji jakości do ceny. Uwzględnienie tych aspektów przesądza o „zielonych” lub „zrównoważonych” zamówieniach. Wśród aspektów jakościowych i środowiskowych możliwe jest określenie kryteriów, takich jak produkty z krótkich łańcuchów lub z bezpośrednich dostaw, dzięki którym żywność lokalna może być przedmiotem „zielonych” i „zrównoważonych” zamówień publicznych.

The author describes how the pandemic impacted the ways of obtaining food provisions and culinary practices of 27 in-depth interview respondents. The study was conducted in May 2021 in Poland, using a structured qualitative interview, with the purposive respondent sample selected using the snowball method. The notion of habit was used in the analysis of the material collected, and the findings were compared to research studies on similar topics available around the world. It was found that the respondents’ habits had changed regarding, among other things, the types of products purchased as well as the places and times of shopping. The threat of the virus prompted customers to take precautions when shopping (such as wearing a mask, keeping a distance, or disinfection). Although the respondents’ culinary habits did not change, new habits appeared - such as baking bread at home. One could argue that a pandemic situation causes a sense of uncertainty resulting from the collapse of the set of hitherto applied routine practices enabling the fulfilment of basic needs, such as obtaining food provisions and socialising requirements.
