The author analyzes the legal nature of the parliamentary mandate as regards a conceivable possibility of limiting the age of a holder of a mandate of a Deputy or Senator. Also, matters related to the principle of the supreme power of the nation and the nature of the legislative power are analyzed. Constitutional bases for the exercise of a parliamentary mandate are discussed, as well as legal restrictions as regards the effective regulation of the status of a Deputy or Senator in a legal act of a rank of a statute.

Przedmiotem opracowania jest jedna z instytucji demokracji bezpośredniej sensu stricto – recall, która funkcjonuje w Polsce na poziomie samorządu terytorialnego. Artykuł ten jest próbą odpowiedzi na pytanie, czy instytucja ta powinna zostać wprowadzona do polskiego porządku prawnego na poziomie ogólnokrajowym. By odpowiedzieć na powyższe pytanie koniecznym jest przedstawienie zasad funkcjonowania tej instytucji w innych państwach. Zastosowanie metody prawnoporównawczej pozwala na zgłoszenie postulatu by wprowadzić taką instytucje do polskiego porządku prawnego. Jednak dopiero praktyka pokazałaby czy stałaby się ona kolejną formą demokracji bezpośredniej czy narzędziem w rękach opozycji.

The subject of the study is one of the institutions of direct democracy sensu stricto – recall, which operates in Poland at the level of local government. This article is an attempt to answer the question whether this institution should be introduced into the Polish legal system at the national level. In order to answer the above question, it is necessary to present the principles of the functioning of this institution in other countries. The use of the comparative legal method allows for the submission of a postulate to introduce such an institution into the Polish legal system. However, only practice would show whether it would become another form of direct democracy or a tool in the hands of the opposition.
