Artykuł prezentuje wyniki badań na temat występowania dyrektywnych aktów mowy w hejcie internetowym. Podstawę materiałową stanowią komentarze znajdujące się pod artykułami zamieszczanymi w jednym z serwisów plotkarskich, w którym publikowane są treści dotyczące życia celebrytów i ludzi ze sfery show biznesu. Przeprowadzona analiza pokazuje, że zachowaniem hejterów nie kieruje jedynie potrzeba wyładowania agresji poprzez deprecjonowanie i obrażanie, ale także chęć wpłynięcia na postawy i zachowania innych ludzi. W tym celu stosują oni strategie, które odpowiadają dyrektywnym aktom żądania, rady, zalecenia, pouczenia, instruowania i grożenia.

The aim of this paper is to analyse the directive speech acts appearing in the phenomenon of hate on the Internet. The research was based on the texts of comments that have been added to the articles published on the webpage dedicated to the stories about celebrities and businessmen. The analysis has shown that it is not only the aggression that makes haters behave in such way but their desire to change other people’s opinions as well. In order to do that various directive speech acts are used among which the advice, the instruction, the admonishment and the threat can be recognized.

The development of modern technologies and the digitization of society contributed to the emergence of a negative social phenomenon such as internet hate. The modus operandi of Internet haters, consisting in posting critical, ridiculing, insulting statements with the use of Internet tools, results in a deceptive belief in the perpetrator’s impunity, which is why Internet hate has been hailed as a modern trend of the Internet environment, having a negative impact on society. Therefore, the doctrine raised the question whether the legislator should not penalize it due to the scale of internet hate. The aim of this article is to analyze the tools proposed by the current wording of criminal law, allowing for an effective fight against the above social phenomenon. The author will analyze the types of crimes, the features of which can be fulfilled by internet hate, focusing her attention on the values protected by the criminal law system. In the course of the publication, an attempt will be made to answer the question whether the current wording of the provisions of the Penal Code sufficiently penalizes, prevents and enables the prosecution of perpetrators of internet hate, or whether it is necessary to introduce changes to the content of the Penal Code.

Rozwój nowoczesnych technologii i cyfryzacja społeczeństwa wpłynęły na powstanie negatywnego zjawiska społecznego, jakim jest hejt internetowy. Modus operandi hejterów internetowych, polegający na zamieszczaniu krytycznych, ośmieszających, obelżywych wypowiedzi za pomocą narzędzi internetowych skutkuje łudzącym przekonaniem o bezkarności sprawcy, dlatego też hejt internetowy został uznany za współczesny trend środowiska internetowego, mający negatywny wpływ na społeczeństwo. W doktrynie pojawiło się zatem pytanie, czy z uwagi na skalę hejtu internetowego ustawodawca nie powinien dokonać jego penalizacji. Celem niniejszego artykułu jest analiza narzędzi proponowanych przez obecne brzmienie przepisów prawa karnego, pozwalających na skuteczną walkę z powyższym zjawiskiem społecznym. Autorka dokona analizy typów przestępstw, których znamiona może wypełniać hejt internetowy, skupiając swoją uwagę na wartościach chronionych przez system prawa karnego. W toku publikacji zostanie podjęta próba udzielenia odpowiedzi na pytanie, czy obecne brzmienie przepisów kodeksu karnego w sposób wystarczający penalizuje, zapobiega i umożliwia ściganie sprawców hejtu internetowego, czy też konieczne jest wprowadzenie zmian do treści kodeksu karnego.
