Artykuł 18 ustawy z dnia 11 września 2015 r. o działalności ubezpieczeniowej i reasekuracyjnej od samego początku budził kontrowersje. Jedną z nich jest precyzyjne ustalenie kręgu adresatów zakazu wynagradzania ubezpieczającego w ubezpieczeniu na cudzy rachunek. Celem niniejszego artykułu jest próba udzielenia odpowiedzi na pytanie, czy zakaz ten obejmuje także agentów ubezpieczeniowych, działających wszak w imieniu i na rzecz zakładów ubezpieczeń. Autorzy prezentują argumentację przemawiającą zarówno za stosowaniem art. 18 wobec agentów, jak i przeciwko niemu. Problem ten jest istotny dla funkcjonowania praktyki ubezpieczeń grupowych po wejściu w życie ustawy o działalności ubezpieczeniowej i reasekuracyjnej.

Article 18 of the 2015 Insurance and Reinsurance Activity Act has been a source of numerous controversies since the day of its adoption. One of those controversies is the issue of establishing a precise circle of recipients of a prohibition to remunerate policyholders in insurance on someone else’s account. The purpose of this paper is to answer a question whether the said prohibition is also aimed at insurance agents who act on behalf of insurers. The Authors present both pro and contra arguments on including agents within the scope of article 18. The said problem is vital to the functioning of group insurance following the entry into force of the 2015 Insurance and Reinsurance Activity Act.
