Przedmiotem artykułu jest problematyka ogólnych warunków ubezpieczenia. Autor analizuje przepisy ustawy o działalności ubezpieczeniowej i reasekuracyjnej dotyczące tej materii i wskazuje na brak ich spójności z przepisami kodeksu cywilnego dotyczącymi wzorców umów, w tym ogólnych warunków ubezpieczenia. Brak konsekwencji ustawodawcy ujawnia się zwłaszcza, jeśli idzie o obowiązki ubezpieczyciela dotyczące doręczenia o.w.u. w ubezpieczeniach na cudzy rachunek. Nowe przepisy rodzą też wiele trudności interpretacyjnych. Dotyczy to zwłaszcza regulacji prawnej tzw. skorowidza do o.w.u., a także obowiązku zamieszczenia o.w.u. na stronie internetowej ubezpieczyciela. W konkluzji autor postuluje kompleksowe unormowanie materii o.w.u. w kodeksie cywilnym, co pozwoliłoby na zapewnienie spójności reżimu prawnego tego wzorca umowy.

The purpose of this article is to discuss the issue of the general conditions of insurance. First of all, the author analyses the provisions of the Insurance and Reinsurance Act regarding this matter and indicates a lack of consistency with the provisions of the Civil Code relating to standard contracts, including the general terms of insurance. The lack of consequences of the legislature is revealed especially in case of the obligations of the insurer concerning the provision of general insurance conditions in insurance on someone else's account. Furthermore, the new provisions lead to a variety of difficulties of interpretation, in particular referring to legal regulation of the so-called index to the general insurance conditions as well as the obligation to post general insurance conditions on the insurer's website. In conclusion, the author calls for a comprehensive normalization of general terms of insurance in the Civil Code, which would ensure the consistency of the legal regime of this standard contract.
