The purpose of the present article is to draw attention to the methodologically oldest method of organizing the classical way of thinking about law. However, the ancient distinction between ius publicum and ius privatum requires considering whether the indicated dichotomy is still justified in the modern world. As a result of observations of the phenomena of privatization of public law and of publicization of private law, it seems that the division into public law and private law is in fact becoming gradually blurred and, above all, it loses its nature of fundamental opposition. Considering the interactions presented here, one should not consider focusing on the differences to be the more constructive approach but rather searching for the similarities between public law and private law.

Celem artykułu jest zwrócenie uwagi na najstarszy metodologicznie sposób uporządkowania klasycznego myślenia o prawie. Antyczne odróżnienie ius publicum od ius privatum wymaga jednak zastanowienia się, czy zasygnalizowana dychotomia znajduje współcześnie uzasadnienie. Wobec obserwacji zjawisk prywatyzacji prawa publicznego oraz publicyzacji prawa prywatnego wydaje się, że podział na prawo publiczne i prawo prywatne ulega w istocie stopniowemu zacieraniu się, tracąc przede wszystkim charakter zasadniczego przeciwstawienia. Wobec przedstawionych tu interakcji za bardziej konstruktywne przedsięwzięcie należy uznać nie tyle koncentrowanie się na różnicach, ile poszukiwanie podobieństw między prawem publicznym a prawem prywatnym.
