Analysis of dimensions of enforcing the responsibility of judges is a subject of the present article in the era of deepening of process judicialization of politics. In the author’s opinion judicialization of politics is indicating the process, in which meaning of courts is growing as organs settling political disputes. This phenomenon is changing the way of understanding the independence of judges and is shedding new light for enforcing their responsibility.

W eseju autorka wskazuje, że sądy pełnią kluczową rolę w konstytucyjnym ustroju państwa w zakresie usuwania niezgody przez neutralnego arbitra. Niemniej, rola sądów nie może ulegać zmianie. Sądy nie powinny zastępować procesu politycznego w warunkach demokracji reprezentatywnej. Jeśli tak się dzieje, wówczas neutralny proces usądowienia polityki (judicialization of politics) zaczyna ulegać dewiacji w kierunku sędziokracji (juristocracy), upolitycznienia sądownictwa (politicization of judiciary) bądź też specjalnego rodzaju usądowienia polityki (special kind of judicialization of politics). Autorka wskazuje, że z tym ostatnim przypadkiem mamy do czynienia w Polsce po 2015 roku. Przedstawia także sytuacje, w których może to wywołać negatywny wpływ na instytucje prawa wyborczego.

In the essay the author points out, that judiciary plays a key role for constitutional system in the scope of resolving of disagreement by a neutral arbiter. Nevertheless, the role of judiciary should not change. In a representative democracy, judiciary should not substitute the political process. If it does, one could identify the deviation from judicialization of politics: juristocracy, politicization of judiciary or special kind of judicialization of politics. The author recognizes the third deviation in Poland since 2015. Additionally, she points out that electoral law can be negatively affected by shifted role of judiciary.
