The aim of the paper is to describe the Polish model of subcontracting employment services by PES. The paper elaborates on the scope of the contractual arrangements, institutions involved in the process and payment procedures. It also presents selected foreign experiences which had an influence on the Polish system of subcontracting. The outcomes of the analysis of this new model led to defining opportunities and threats which may arise as a results of its implementation within the framework of labour market policy.

Celem artykułu jest wyjaśnienie istoty polskiego modelu kontraktacji usług rynku pracy. Scharakteryzowano w nim przedmiot i podmioty kontraktacji oraz zasady, na podstawie których realizatorzy kontraktu są wynagradzani. Wskazano również rozwiązania zagraniczne, które miały wpływ na kształt tego modelu. Przeprowadzona analiza modelu pozwoliła określić pewne szanse, jak i zagrożenia, jakie mogą pojawić się na skutek jego funkcjonowania w obszarze rynku pracy.

Constant changes in the Polish labour law after the shock therapy in the 1990s implicate a situation of uncertainties for both sides, for the workers and for the employers. Migrant workers, for whom the deregulation of the labour market provides niches free of state control, are a special target of precarization. The purpose of this thesis is to examine the strategies which Ukrainian migrants in Warsaw face in their labour relations and which practices they use to create security in the context of informal economies and shortterm migration within these niches. It is for the first time that a Polish research on labour migration reflects the position of trade unions in the migration system and that the analysis applies Guy Standing’s concept of precarity on Central Europe’s migration systems. Using qualitative matrial it provides a new approach to the Polish labour market from a peripheral perspective. The thesis summarizes qualitative field research using methods proposed by the Warsaw-based tradition of legal anthropology. By adaption of the term “legal consciousness” it analyses the main factors of setting up legal assertiveness of Ukrainian migrant workers in Warsaw.

Praca ma charakter socjologiczno-prawny i wzbogaca dotychczasowe badania nad migracjami ukraińskich pracowników do Polski koncepcją świadomości prawnej. Na podstawie jakościowych badań analizowano mechanizmy stosowane przez pracodawców, prowadzące do prekaryzacji pracowników migrujących oraz mechanizmy ochrony tej najbardziej podatniej na nadużycia grupy na polskim rynku pracy. Do pokazania ograniczeń praw obywatelskich i pracownicznych pracowników migrujących użyto koncepcji prekariatu Guya Standinga. Z ich peryferyjnej pozycji prezentuje się krytyczny obraz transformacyjnej gospodarki i jej słabości.
