The article is dedicated to the issue of countersigning of some legal proceedings by the treasurer of a local self-government unit. Since municipalities are a frequent participant in civil-law proceedings, the issue is very important from both theoretical and practical perspective. The author pays particular attention to the significance of countersignature as for the validity and effectiveness of legal proceedings, he also discusses issues related to conclusion of agreements. This is justified by the scale and importance of bilateral proceedings. However, many issues related to conclusion of agreements can be applied in the field of all legal proceedings, including unilateral.

The article focuses on a description of the basic tools supporting non-verbal communication in court in administrative judicial proceedings. The basic parameters determining the rhythm of interaction between the participants in the process and the court are the courtroom and its architecture (determining the basic conditions of the kinesic code: time and pace) as well as appearance (including official dress). Those non-linguistic categories influence the identification of the participants in the proceedings as members of one communication community within which the legal reality becomes transformed. Statements of the parties, given the professional ethical standards binding on lawyers, should be characterised by moderate gesticulation and voice intensity. If a lawyer violates customary norms regulating forms of speech and self-presentation, this may have disciplinary consequences.

The article under consideration examines the legal settlement of disputes, including commercial disputes, through mediation in the context of the legislative work regarding mediation in Ukraine. The author concludes on the need of consolidation of provisions in legislation on mediation, taking into account the experience of other states, as well as amending relevant current legislation of Ukraine.

The protection of children and their rights is one of the fundamental topics in all democratic states. The objective of the quantitative research was to find out how minors are engaged in the court proceedings regarding their upbringing and whether the court takes their views into account when it comes to decision-making. The research is rooted in two key concepts – child participation and the form of their participation. Method: The research sample was made up of court decisions involving the upbringing of minors, and finally and firmly terminated in 2015 and 2016 at two district courts in one region in the Czech Republic. The content analysis of documents was used to collect the data. Results: The final selected data resulting from one-dimensional and two-dimensional analysis deliver interesting, and often alarming findings. Discussion: The resulting data are in conflict with valid legislation, but they often confirm the rigid Czech judiciary practice in the area of decision- making when it comes to the upbringing of a minor. All these findings are properly discussed.

Accordingly, the reason and will of a juristic person will always represent “someone else´s reason and will” as they will always come from “someone else”. From this viewpoint, a juristic person cannot enjoy legal capacity stricto sensu, and can merely be considered to “have” such capacity.

Article is a detailed study on the UK Supreme Court judgment in the most debated platform economy misclassification case in recent years. The elaboration on the judgment seemed necessary for two main reasons. Firstly, it is a kind of culmination of a certain platform saga. Secondly, the judgment provides valuable technical guidance for any labour court (regardless of jurisdiction) faced with the task of determining the existence of an employment relationship between a platform and a user who provides the work (service) within platform.

Autorka omawia wyrok brytyjskiego Sądu Najwyższego z 19 lutego 2021 r. w najbardziej dyskutowanej na przestrzeni ostatnich lat misklasyfikacyjnej sprawie platformowej. Szczegółowe omówienie wyroku wydaje się ważne przede wszystkim z dwóch powodów. Po pierwsze jest to swego rodzaju zwieńczenie pewnej sagi platformowej. Po drugie orzeczenie dostarcza wskazówek technicznych przydatnych dla każdego sądu pracy (niezależnie od jurysdykcji), który stanie przed zadaniem rozstrzygnięcia sprawy o ustalenie istnienia stosunku pracy między platformą a wykonawcą pracy (usługi) platformowej.
