Artykuł poświęcony jest ewolucji transakcji pozarynkowych nieruchomości na przełomie lat 2003–2013. W pracy dokonano analizy transakcji nieodpłatnego zbycia nieruchomości w formie umowy darowizny, umowy dożywocia, umowy o dział spadku, którego przedmiotem są nieruchomości, umowy zbycia nieruchomości w zamian za wypłatę świadczeń z ubezpieczeń społecznych w skali całego terytorium Rzeczypospolitej Polskiej w latach 2003–2013. Omówione zostały aspekty podatkowe pozarynkowych transakcji nieruchomościami, zdefiniowano też poszczególne umowy oraz przedstawiono najważniejsze kwestie prawne ich funkcjonowania. Autorzy podjęli rzadko analizowany problem bezpieniężnych zmian własności nieruchomości. Praca dotyczy umów: darowizny, umowy dożywocia, umowy o dział spadku (którego przedmiotem jest nieruchomość), umowy zbycia nieruchomości (w zamian za wypłatę świadczeń z ubezpieczeń społecznych).

The article is devoted to the evolution of off-market real estate transactions market at the turn of the years 2003–2013. The paper analyses the number of transactions of the gratuitous transfer of a real estate in the form of a donation agreement, a life estate deed, an inheritance division agreement the object of which are real properties, a real estate transfer agreement in return for the payment of social insurance benefits in the scale of the whole territory of the Republic of Poland in the years 2003–2013. The article discusses tax aspects of off-market real estate transactions and defines individual types of agreements, it also presents the most important legal aspects of their functioning. The Authors entered into the rarely discussed problem of non-monetary changes of real estate ownership. The paper is devoted to: gift agreement, annuity agreement, estate distribution agreement (where the subject is real property), real estate sale agreement (in exchange for payment of national insurance benefits/allowance).
