The article is a vote on issues currently under Polish administrative law limiting the implementation of projects resulting from the need to obtain an environmental decision. In a democratic state, the protection of individuals against excessive state interference in the sphere of constitutional freedoms and rights is an immanent feature. For this reason, any permissible state interference must fulfill the requirements and be present only in the context of the conflict of good of a particular entity, individual and social good. There is no doubt that nowadays the premise of the introduction and functioning of constraints can be environmental protection, understood as a common good deserving of preserving current and future generations. The environmental protection mechanism is therefore a broadly understood environmental assessment and the administrative decision that is issued as a result of the legal situation of the entity seeking to use the environment in a specific way.

Opracowanie stanowi głos w kwestii obecnie obwiązujących w prawie polskim administracyjnoprawnym ograniczeń realizacji przedsięwzięć wynikających z konieczności uzyskania decyzji środowiskowej. W demokratycznym państwie prawnym ochrona jednostki przed nadmierną ingerencją państwa w sferę konstytucyjnych wolności i praw jest cechą immanentną. Z tego powodu każda dopuszczalna ingerencja państwa musi spełniać odpowiednie wymogi oraz występować jedynie w sytuacji konfliktu dobra określonego podmiotu, jednostki oraz dobra ogólnospołecznego. Nie ulega wątpliwości, iż współcześnie przesłanką wprowadzania i funkcjonowania ograniczeń może być ochrona środowiska, pojmowana jako dobro wspólne zasługujące na zachowanie dla obecnych i przyszłych pokoleń. Mechanizmem wprowadzenia ochrony środowiska jest szeroko rozumiana ocena środowiskowa i wydawana w jej wyniku decyzja administracyjna mogąca kształtować sytuację prawną podmiotu zmierzającego do korzystania w określony sposób ze środowiska.
