This article aims to analyze the thematic of medical team liability considering the recent Italian Supreme Court case-law, highlighting the various problems linked to the identification of the responsibility of each member of the team. The participation of several subjects in the execution of medical treatment makes the question of criminal liability very complex, especially when it comes to inauspicious events, such as injuries or death, occurring during medical treatment. The question concerns the exact identification of the duty of care and vigilance of the medical team and whether this duty is in line with the principle of individual criminal responsibility guaranteed by Article 27 of the Italian Constitution. In this regard, the case-law has elaborated the so-called “principle of reasonable confidence”, according to which the division of labour that belongs to each member should involve a delimitation of his responsibility, limited only to what is within his competence, except in case of the person who organizes, directs, and controls the team. Precisely, based on this principle, the Italian Supreme Court in 2018 reasserted that in the medical team is necessary to identify the role played by each member, thus avoiding resorting to objective responsibility.

This article focuses on the issue of the loss of chance doctrine. It consists mainly of the most important parts of a debate and a conclusion contained in the thesis of the author of this article. The article evaluates arguments for and against the use of the loss of chance doctrine and offers the conclusion that the mentioned doctrine is applicable in Czech law. This conclusion is supported also by interpretation of relevant stipulations of the Czech civil code. The article also works with possible alternatives to the mentioned doctrine and establishes reasons why the loss of chance doctrine should prevail as a solution of problems connected to the medical liability cases such as uncertainty of the outcome of unlawful conduct.

Tento článek se zabývá problematikou teorie ztráty šance. Sestává převážně z nejdůležitějších částí debaty a závěrů obsažených v autorově diplomové práci. Zvažuje argumenty pro a proti užití teorie ztráty šance a nabízí závěr, že zmíněná teorie je v rámci českého práva aplikovatelná. Tento závěr je podpořen rovněž interpretací relevantních ustanovení českého občanského zákoníku. Článek pracuje také s možnými alternativami k řečené teorii a zakládá důvody, proč by teorie ztráty šance měla převážit jako řešení problémů spojených s medicínskou odpovědností jako je nejistota ohledně následků protiprávního jednání.
