The article contains a presentation of the Reinsurance Directive guidelines and specific regulation of this activity in Polish law. The issue of business of reinsurers headquartered outside the European Economic Area has been widely discussed on the basis of a comparative legal analysis. The immediate consequences of the existing legal situation in Polish law have been emphasized. The author has also made de lege ferenda proposals calling for the absorption of an Austrian model into the current work concerning a new insurance contract as for the place of establishment of an insurer in direct insurance as well as a reinsurer.

Artykuł zawiera prezentację założeń dyrektywy reasekuracyjnej oraz specyfiki regulacji tej działalności w prawie polskim. W sposób szczególny omówiono w oparciu o analizę prawno- porównawczą, zagadnienie działalności reasekuratorów z siedzibą poza Europejskim Obszarem Gospodarczym. Wskazano także na szczegółowe konsekwencje istniejącego obecnie stanu prawnego w prawie polskim. Autor sformułował również wnioski de lege ferenda postulując, aby w aktualnych pracach nad nową umową o działalności ubezpieczeniowej dokonać absorpcji modelu austriackiego co do określenia miejsca działalności zarówno ubezpieczyciela w ubezpieczeniach bezpośrednich, jak i też reasekuratora.
