In the modern conditions of development of Poland and Ukraine the problem of criminal and legal protection of the moral foundations of society from the crimes related to the illegal trade of pornographic items is of high importance. Due to this, the article examines the criminal provisions in respect of liability for actions related to the illegal trade of pornographic items in the legislation of 27 foreign countries and Ukraine. The author has used specific scientific methods of cognition (comparative legal method, methods of modeling, monitoring, system method, mathematical method, etc.) and identified the features of the object and objective of relevant offences. The study also examines international acts that contribute to the legal protection of the whole of society and individuals from the dissemination of pornography, especially child pornography. Based on the study of the regulatory framework, and taking into account theoretical works, the author suggests improvements to the criminal law. The article presents conclusions, which state that the Ukrainian approach is not typical of the Criminal Codes analyzed of the foreign countries as determining the typological object of offences related to the illegal trade of pornographic items as they do not combine public order and morality. The criminal laws of Poland and Korea have great potential for the improvement of our approach; they combine sexual freedom and morality (sexual morality) when determining the typological object of offences related to the illegal trade of pornographic items. The paper also emphasizes the need to implement the provisions of the Convention for the Protection of Children against Sexual Exploitation and Sexual Abuse of 25 October 2007, in particular, to criminalize the organization of access to child pornography as a new form of crime.

Suppose that a suspect being questioned by the police says, "I think I'd better talk to a lawyer." Whether that suspect has invoked her right to an attorney depends on which particular speech act(s) her utterance is. If she is merely thinking aloud about what she ought to do, then she has not invoked that right. If, on the other hand, she has thereby requested a lawyer, she has. Similarly, suppose that an unhappily married man says "I want my wife dead." Whether he has thereby solicited his wife's murder depends on which particular speech act(s) his utterance is. If he is merely describing his desires, he has committed no crime. If, by contrast, he has thereby hired an assassin, he has. As one can see, experts on speech acts (e.g. philosophers, linguists, psychologists and sociologists) have a lot to say about various issues in the law.I believe that expertise in speech act theory also illuminates various issues regarding free speech. In what follows, we consider how speech act theory may apply to certain arguments regarding the free speech status of pornography. In particular, we consider several speech act accounts of MacKinnon's claim that pornography subordinates women, but, before turning to such accounts, some background is offered.

This essay explores meaning complexity of pornographic materials conceived as quasi-private though its true “professional” provenience. The main subjects of analysis are easily accessible ads of various paid X-rated websites. Author treats advertising texts as a source of knowledge about narrative strategies and stereotypes. An interpretative tool chosen for the task is Mikhail Bakhtin’s Theory of Carnival – in particular: concept of “grotesque realism” and four fundamental categories of “carnivalesque” (familiar interaction between people, eccentric behavior, misalliances, sacrilegious). The article is based on the results of research conducted in the years 2002–2004.

According to the author, the suggested amendment is not justified. Prosecution of displaing pornographic materials in a way which enables minors to access them, is already regulated in the Polish Criminal Code. Proposed amendments would be a duplication of existing provisions, additionally causing interpretation problems. The other suggested change – introducing a definition of pornography – would not be useful in solving interpretation problems, since that definition has many drawbacks.

Fanfiction – fan literature based on a popular work – is a big, largely inconsistent group of the Internet-based creative activity. A large part of this production is devoted to relationships in various forms. In addition to romantic entanglements, the authors’ attention is more or less devoted to erotic topics balancing on the edge of pornography or even openly pornographic. The contribution will be based on the Czechoslovak fanfiction written inside the fandom of J.K. Rowling’s Harry Potter. It aims to introduce various forms of erotic and pornographic fan production, especially categories that deviate in any way from  normality. Attention will also be paid to the so-called slash (gay story) that belongs to the most popular and most widespread in the fandom. It is also one of the most discourteous and undesirable, which is due, among other things, to the fact that it combines characters that are heterosexual in the original work. Another addressed topic is the communication between authors and readers. This communication is an inseparable part of fanfiction and fan community in general. The aim is not only to characterize the ways of this communication, but rather to describe its specifics within pornographic fanfiction. It focuses on the so-called ratings and warnings, but not forgetting readers’ comments, discussions with them, or attempts at censorship (from readers and webmasters), including self-censorship.

The article discusses visual representations of eroticism in commercial media content for mobile phones, ranging language-wise from pornographic to infantile. The author considers it as a discursive form in which both domination of verbal elements over visual ones and consumer's desire over satisfaction could be pointed out. The article notes the alienating dimension of pornography in the era of media convergence.

Pornography is among the phenomena which have not been clearly defined in the subject literature yet. The ambiguity of the phenomenon promoted in contemporary social and cultural reality and its normalization causes that it can be interpreted and evaluated in many different ways. Available research and analyses lack any approach that would describe how pornography affects the development and behavior of youth in different care and upbringing environments. This article aims to discuss the results of the author’s study related to family determinants of youth’s attitudes towards pornography. The author’s intention is to initiate a discussion and a further study of this topic. The study was based on a sample of 127 students. To obtain empirical data, a survey questionnaire created by the author was used. Through this analysis, an attempt was made to find answers to the question if selected variables of a family environment (the type of parental relationship, type of parenting style in a family, a sense of emotional support from parents, values adopted by parents) differentiate a youth’s attitudes towards pornography in cognitive, emotional and behavioral aspects.

The Fifty Shades series has brought erotic fiction to a broader and more mainstream audience than ever before. In its wake, a number of erotic romance series have achieved unprecedented popularity, such as Sylvia Day’s Crossfire series and Lisa Renee Jones’ Inside Out series. These books do not fit comfortably into the genres of romance or pornography: rather, they fuse the romantic and pornographic together. This locates the multiple climaxes of pornography within the overarching emotional climax of romance and creates a structure that is both finite and infinite, allowing the books to create both instant and delayed gratification. This article examines The Sheik as a textual forebear to Fifty Shades before moving on to examine the ways in which romance and pornography are fused, overcoming the limits of serialization in romance, and creating a romantic “pornotopia.”

The paper discusses contemporary condition of French erotic or/and pornographic novel. As social and cultural circumstances seem to put an end to its transgressive potential, the authors of this kind of writing tried, at first, to keep abreast of other media. Nevertheless, the “trash” or “grunge” novel as well as autofictional erotic writings were not able to satisfy the critics. The novels from L’instant erotique collection, written by specialists of erotic art, change the strategy and exploit the new state of cultural relations in which the role of this sort of literature is rather to imitate or to play with erotic or pornographic tradition, creating a new model of reception: very conscious and erudite.

Exploitation films are one of the main trends of the Serbian cinema of the beginning of the 21st century, when Serbia enters the second phase of systemic transformation, striving to neutralize the effects of the crisis in the first phase of transformation – towards the end of the 20th century – due to the authoritarian policy of Slobodan Milošević and Yugoslav wars. This non-film context allows better understanding of the phenomenon of these films, which in many respects are a continuation of the cinema of self-balkanization cultivated in the 1990s, and at the same time differ from it, because they do not offer a compromise with difficult transformational reality, but express the need to release the social trauma born of experience of political violence in the Milošević era.

The article attempts to analyze the poetry of Katarzyna Fetlińska with the main stress laid upon her volume Sekstaśmy (Sex Tapes). The author tries to verify critical tracks and generalizations, introduced mostly by editorial and publishing descriptions which promote the collection. He exposes the importance of dramatic and surprisingly non-ironic themes chosen by the poet, who confronts herself with the most tragic aspects of human existence: loneliness and death. The main theme of the sketch is eroticism, sexuality and even pornographic character of her poetry, directed against metaphysically scandalous friability of interpersonal relations, human objectification and nothingness of being.

Niniejszy artykuł stanowi próbę podsumowania zagrożeń związanych ze zjawiskiem, jakim jest pornografia. Praca ma wymiar teoretyczno-praktyczny. W pierwszej kolejności zostanie przedstawiona część teoretyczna oraz wnioski płynące z przeglądu dostępnej literatury. Następnie zaprezentowane zostaną wybrane przykłady case study zaczerpnięte z praktyki psychologicznej odnoszącej się do działalności w telefonie pomocowym UMCS w Lublinie. Inicjatywa ta miała początek w marcu 2020 w momencie rozpoczęcia pracy zdalnej z powodu koronawirusa. Telefon przeznaczony był głównie dla studentów UMCS. Celem niniejszej pracy jest ukazanie wybranych zagrożeń związanych z korzystaniem ze stron pornograficznych w warunkach upowszechnienia Internetu. W pracy zostanie przedstawiony przykład case study 29-letniej kobiety w aspekcie trudności psychologicznych po wykorzystaniu filmu pornograficznego bez jej zgody. Dodatkowym przykładem będzie kwestia uzależnienia 31-letniego mężczyzny od pornografii oraz zmniejszenie możliwości prokreacyjnych.

This article is an attempt to summarize the risks associated with phenomenon of pornography. The work has a theoretical and practical dimension, because in addition to the theoretical part and a review of the available literature, the aspects related to the presentation of selected examples of case studies from the authors’ psychological practice regarding the activity on the help telephone of Maria Skłodowska-Curie University in Lublin were dealt with. This initiative started in March 2020 when he started working remotely due to the coronavirus. The phone was intended mainly for UMCS students. The aim of this study is to present selected threats related to the use of pornographic websites in the conditions of popularization of the Internet. The paper presents an example of a case study of a 29-year-old woman in the aspect of psychological difficulties after using a pornographic film without her consent. An additional example will be the question of the addiction of a 31-year-old man to pornography and the reduction of reproductive possibilities.

Opozycja treści i formy jest jednym z fundamentów (i złudzeń) klasycznej estetyki. Pojęcia te nie tylko funkcjonują jako przeciwieństwa i korelaty, ale bywają też „wymazywane” – jak w filmowej pornografii, czyli kinie mechanicznie replikowanej formy, kinie bez treści lub z treścią schematyczną i pretekstową. W historii filmu porno szczególne miejsce zajmują jednak Chłopcy na piasku Wakefielda Poole’a (1971). Film ten neguje formalne schematy pornografii, które reżyser zastępuje formą autorską, odsyłającą do tradycji modernizmu i sztuki gejowskiej oraz dialogującą z różnymi nurtami kina. Dzięki specyficznej organizacji czasu, lirycznej tonacji i wizualnej jednolitości Chłopcy… są więc filmem formy, ale à rebours; forma ta generuje treść. Dzieło Poole’a ma bowiem wymowę emancypacyjną i transgresyjną. Jego wartość artystyczna polega zaś na tym, że cielesność i seksualność są przepisywane na autorski język filmowy, metaforyzowane i kontekstualizowane w polu skojarzeń kulturowych.

The opposition between content and form is one of the foundations (and illusions) of classical aesthetics. These concepts not only function as opposites and correlates, but sometimes they are “erased” – as in pornographic films of a mechanically replicated form, with no content or with schematic and pretext content. However, Wakefield Poole’s Boys in the Sand (1971) occupies a special place in the history of porn. This film negates the formal patterns of pornography, which the director replaces with an authorial form, referring to the traditions of modernism and gay art, and dialoguing with various trends in cinema. Due to the specific organization of time, lyrical tonality and visual uniformity, Boys… are therefore a film of form, but à rebours, and this form generates content, both emancipatory and transgressive. Its artistic value lies in the fact that corporeality and sexuality are rewritten into the original film language, metaphorized and contextualized in the field of cultural associations.

In the article ”The Broker of Pornography and Violence: Lou Reed in Lulu’s World”, Sławomir Kuźnicki analyses the literary and cultural layers of Lulu, the album published by Lou Reed in collaboration with Metallica, based on Frank Wedekind’s two modernist dramas: Earth Spirit (1895) and Pandora’s Box (1904). The rock poet treats the plot of the two plays very loosely and it becomes the means through which he enters the area of disturbing perversion and graphic pornography. This strategy, then, is typical for him: drawing on the primal instincts of human sexuality, he penetrates these experiences that – although frequently marginalized – are the foundations of our culture. Consequently, Reed seems to follow Susan Sontag’s diagnosis according to which the goal of pornographic literature is to disorient and to disturb mental balance. In the case of Lulu, this strategy of cultural disorientation is also implemented via the generic form of the record. This form mainly stems from Reed’s decision to cooperate with Metallica, i.e. a band whose conservative and rather sustainable music stands in contrast to the former artist's transgressive arts. In other words, on many levels it demonstrates Reed’s strategies of crossing the borders between what is commonly accepted and what is rejected because of its non-normative quality. It results in multilayered kinkiness that outreaches the literary frames of the project and makes it possible to view Lulu as a piece of art that is both uncompromising and visionary.

The paper deals with the legislative activity of local government bodies in relation to so-called “problem resolutions” The scope of the article covered over 50 resolutions on sexual ethics issues. Problem resolutions of municipal (county, regional) councils are sequentially discussed in the following sub-sections: gender ideology, public expression of the views of the LGBT movement, legalization of same-sex unions, pornography and prostitution. According to the author, the best form of control of the given resolutions is social control carried out by the residents of local communities within the framework of the electoral mechanism. Sub-jecting such resolutions to substantive review by the administrative courts would result in the judiciary’s entanglement in axiological, philosophical, historical and political disputes. Recognisable shortcomings in the functioning of the title institution should not obscure the importance of problem resolutions as a form of local government expression.

The centers of assistance and support − governmental and non-governmental, specializing in the diagnosis and treatment of addiction that support addicts and their loved ones. Only full cooperation of centers and support groups and involvement of all family members can restore the addict's hope and change lives.

Człowiek, uzależniony od pornografii lub hazardu, potrzebuje pomocy, gdyż jest osobą chorą. Potrzebuje pomocy i porady fachowców, gdyż próby zapanowania nad uzależnieniem zwykle kończą się porażką. Służą temu ośrodki pomocy i wsparcia, rządowe i pozarządowe, specjalizujące się w diagnostyce i terapii uzależnień, które wspierają osoby uzależnione i ich bliskich. Jedynie pełna współpraca ośrodków i grup wsparcia oraz aktywność wszystkich członków rodziny może przywrócić uzależnionemu nadzieję i zmianę życia.

The paper deals with a detailed analysis of the characteristics of emotional discourse, organized in a literary text, specifically in the novel Gullo Gullo by Miodrag Bulatovic. Since expressing of emotions can be verbal and non-verbal, both codes relating the organization of emotional discourse have been activated. In the analysis of literary coded emotional discourse the author had to consider two-instance system of art. The fiction as a basic distinctive feature of a literary text has a crucial influence on the emotional semiosis resulting in producing emotional meaning. That process has always been influenced by various features of poetic language and its combinatorics, which are significantly different from encoding in real chronotope expressed in native language forms, governed by quite different rules of expressing emotions and transferred by the people and not the literary structure. Since the fact that disorders of phatic function of a language, communication and culture, are defined as major agents of the process in question their accepted values novels written by Miodrag Bulatovic, the author points out the importance of carnival, grotesque, pornography and satire which have been used as the main degradation processes of the canonized cultural and communication patterns in the novel, whose destructive operation inevitably affects the emotional discourse.

It shall not be doubtful that pornography is very detrimental particularly for children. As a consequence children shall be protected against pornography in the Internet. However, introduction of the legal provisions on blocking the Internet access to pornography in the interest of children results in a number of problematic issues, such as collision with economic rights (EU internal market freedoms) or freedom of speech. The analysis carried out in the article results in a conclusion that introduction of such restrictions is nevertheless legally possible and reasoned. It is also pointed out that because at the time being the EU does not intend to adopt appropriate legally binding measures, it is for national legislators to confront the problem. The question is therefore not if access shall be restricted, but how to do it, in particular, whether it shall be restricted on the basis of normative regulation or on the basis of self-regulation.

Autorka przedstawiła poglądy panujące w doktrynie oraz orzecznictwie związane z tą problematyką.

Without a doubt issues connected with spreading pornographic contents raise a lot of discussions among lawyers and ordinary citizens. The author covered the problem of criminal liability concerning the phenomenon of spreading pornographic contents. In the publication, one may find references to both currently binding, as well as previous criminal codes. The author also introduced doctrine and jurisprudence points of view on the problem in question.

The article begins with stating a fact that in Bolesław Prus’s "Kroniki" there are many fragments (especially those, in which black women occur), which sound so obscene that, according to contemporary standards, they could be considered pornographic. This lead to a conclusion that the conviction about an absolute prudery of the contemporary official circles and a current image of Bolesław Prus has to be modified. The next part of the article is devoted to an attempt to find the reasons why exactly this topic of African women provoked the author of "Kroniki" to come up with erotic fantasies (one of them was a belief in the moral inferiority of African inhabitants widespread in the 19th century), and also to more detailed analysis of the most characteristic fragments of "Kroniki" containing all these fantasies (embedding the image of women, created by its author, in the context of other colonial narratives).
