Problematyka wynagrodzenia brokera ubezpieczeniowego nie jest uregulowana w przepisach prawa. Nieczęsto jest ona także przedmiotem orzecznictwa sądowego. Wydano jednak w Polsce kilka judykatów, które pozwalają na sformułowanie pewnych wniosków dotyczących postrzegania przez orzecznictwo kluczowych problemów związanych z wynagradzaniem brokera. W szczególności, co do zasady akceptowana jest praktyka wypłacania brokerom kurtażu przez ubezpieczycieli. Po drugie, orzecznictwo poszukuje podstawy prawnej płatności kurtażu w porozumieniu zawieranym pomiędzy brokerem ubezpieczeniowym a ubezpieczycielem. Po trzecie wreszcie, przesłanką płatności prowizji brokerskiej jest faktyczny wkład brokera w doprowadzenie do zawarcia umowy ubezpieczenia.

Insurance broker's remuneration is not regulated by legislation. Besides, it is not offen the subject of the case law. Nevertheless, a few court decisions have been passed in Poland, which enable us to formulate certain conclusions on the perception of the key issues related to broker's remuneration by the case law. Firstly, in principle the payment of brokerage to brokers is an accepted practice applied by insurers. Secondly, the case law is seeking a legal basis for the brokerage payment in the agreement concluded between an insurance broker and an insurer. Thirdly, the actual contribution of the broker to the conclusion of the insurance contract is the condition for the payment of brokerage commission.
