"Processus brevior" – zwykła formalność czy wyraz wielkiego zaufania?

L’articolo riguarda la questione della procedura del processus brevior. In primo luogo, l’autore dell’articolo richiama l’attenzione sulle termini processuali richiesti per tribunale di primo grado il quale ha dichiarato la nullità del matrimonio e deve trasmettere di ufficio al tribunale di apello la sentenza, gli atti del giudizio e gli eventuali appelli delle parti e del difensore del vincolo. Inoltre presenta i concetti dei canonisti in quanto alla necessità di trasmettere alle parti l’osservazioni del difensore del vincolo della seconda istanza, redatte secondo il can. 682 § 2 CIC. Oltre a ciò porta le situazioni quando non esiste la possibilità di applicare la procedura di processus brevior: il processo documentale, la sentenza negativa ed anche di solito l’appello della parte convenuta contro la sentenza positiva. La certezza morale e la pronunzia del tribunale dev’essere preceduta da un attento esame degli atti. Ovviamente il tribunale di appello deve motivare il decreto in modo autonomo con motivi in iure e in facto e anche con speciale riferimento ai osservazioni del difensore del vincolo.

W artykule zwrócono uwagę na zadania obrońcy węzła we wszystkich etapach postępowania. Jego głównym zadaniem w procesie jest zebranie wszystkich argumentów na korzyść ważności małżeństwa.

The article deals with the status of a defender in the proceedings of the nullity of marragie after the reform of the marriage process by Pope Francis, Mitis Iudex Dominus Iesus. Attention is paid to the tasks of the defender of the bond at all stages of this proceeding. In the proceeding, the defender of the bond is summoned to gather all the arguments in favour of the validity of the marriage.

Proces skrócony jest nową instytucją prawną wprowadzoną przez motu proprio Mitis Iudex Dominus Iesus. Ma on na celu uprościć i przyspieszyć procedurę rozpatrywania spraw o stwierdzenie nieważności małżeństwa, przy jednoczesnym poszanowaniu wszelkich zasad dotyczących nierozerwalności węzła małżeńskiego. W pracy zawarte zostały najważniejsze zagadnienia, z którymi muszą zmierzyć się i o których muszą wiedzieć zainteresowani złożeniem prośby o rozpatrzenie skargi w procesie skróconym. Określenie koniecznych przesłanek do rozpoczęcia procesu, a także opisanie poszczególnych etapów procesu z uwzględnieniem konkretnych terminów, powinno ułatwić odnalezienie się w nowej rzeczywistości przepisowej, a także zdefiniować, jaki rodzaj spraw kwalifikuje się do rozpatrzenia w procesie biskupim.

The shorten process is a new legal institution, introduced by motu proprio Mitis Iudex Dominus Iesus. It’s aim is to simplify and make the marriage invalidation process faster, respecting the rules of inseparable marriage bonds. The thesis includes the most important issues which have to face and know people who are interested in taking into consideration their complain in the shorten process. The definition of circumstances, necessary for process beginning, as well as description of process stages with regarding the concrete dates, should make the definition of what type of cases should be qualified for taking into bishop’s process consideration easier.

The aim of the article is to outline the role of the diocesan bishop in the shortened process for nullity of marriage. The bishop is the only judge here and cannot delegate this authority to anyone. The first part of the article presents the reasons for the application of the shortened process. The second part presents the formal elements necessary to initiate the shortened process, while the third part is devoted to the issues of the diocesan bishop as the only judge in the processus brevior.

Celem artykułu jest nakreślenie roli biskupa diecezjalnego w procesie skróconym o nieważność małżeństwa. Biskup jest tu jedynym sędzią i nie może tej władzy nikomu delegować. W pierwszej części artykułu ukazano przesłanki dla zastosowania procesu skróconego. W części drugiej przedstawiono elementy formalne konieczne dla wszczęcia procesu skróconego, natomiast część trzecia została poświęcona problematyce biskupa diecezjalnego jako jedynego sędziego w processus brevior.

Since the beginning of the pontificate of Pope Francis we have heard in his preaching the calling to reform the structures of the church. Bergoglio presented his pastoral-evangelical idea of the functioning of the Church in the exhortation Evangelii Gaudium. Naturally the reform made by the Bishop of Rome also applies to the canon law. Directed by voices of hierarchy gathered at the Synod of Bishops 2014 and the spiritual good of the faithful, who are waiting for an explanation of their canonical situation, 15 August 2015 Pope Francis promulgated the Motu proprio Mitis Iudex Dominus Iesus, to accelerate and simplify the process of annulment of the marriage. Pope wanted the heart of the faithful were not too long enslaved by darkness of doubt because of delays in the judgment. In the center of his reform Pope put the diocesan Bishop, who together with the Bishop of Rome becomes the guarantor of the unity of the Catholic faith and discipline. According to the principles of the reform, the bishop not only organizes and is responsible for the court structure in the local church, but he also has to personally fulfill the task of the first judge of the faithful, for whom he was established a shepherd. The new laws allow the bishop to establish a single judge and introduces the institution of processus brevior, which is provided for particular obvious situations. The only judge in this process is the bishop. It seems that the reform process of marriage, made in the spirit of historical continuity, will bring much spiritual fruit and contribute to the perception of the person the diocesan bishop not only as pastor bonus, but at the same time as iustus iudex.

Od początku pontyfikatu papieża Franciszka słyszymy w jego przepowiadaniu nawoływanie do reformy struktur kościelnych. Swoją pastoralno-ewangeliczną koncepcję funkcjonowania Kościoła Bergoglio przedstawił w adhortacji Evangelii Gaudium. Naturalnie, reforma dokonywana przez Biskupa Rzymu dotyczy również prawa kanonicznego. Kierowany głosami hierarchów gromadzonych na Synodzie Biskupów w 2014 roku oraz dobrem duchowym wiernych, którzy oczekują na wyjaśnienie swojej sytuacji kanonicznej, papież Franciszek 8 września 2015 roku promulgował Motu proprio Mitis Iudex Dominus Iesus tak, by przyspieszyć i uprościć proces stwierdzenia nieważności małżeństwa. Wolą Papieża było ty, by serca wiernych nie były zbyt długo zniewolone przez mroki wątpliwości z powodu opóźnień w wydaniu wyroku. W centrum swojej reformy Ojciec Święty postawił postać biskupa diecezjalnego, który wraz z Biskupem Rzymu staje się gwarantem katolickiej jedności w wierze i dyscyplinie. Według założeń reformy, biskup nie tylko organizuje i odpowiada za strukturę sądowniczą w swoim Kościele lokalnym, ale ma również wypełniać osobiście zadanie pierwszego sędziego wiernych, dla których został ustanowiony pasterzem. Nowe ustawodawstwo daje biskupowi możliwość ustanowienia sędziego jednoosobowego oraz wprowadza instytucję processus brevior, który przewidziany jest w sytuacjach szczególnie oczywistych. Jedynym sędzią w tym procesie jest sam biskup. Wydaję, że reforma procesu małżeńskiego, dokonana w duchu ciągłości historycznej, przyniesie wiele owoców duchowych i przyczyni się do postrzegania osoby biskupa diecezjalnego nie tylko jako pastor bonus, ale jednocześnie jako iustus iudex.
