Procedura uszlachetniania czynnego w Unii Europejskiej

The research issues of the article focus on the principles constituting the procedure of inward processing in economic transactions. While, in accordance with the general principle of choice of procedure, each declarant may choose the customs procedure under which the goods will be placed, under the conditions provided for this procedure, regardless of the type, quantity, country of origin, dispatch or destination of the goods, the essential purpose of this procedure is to submit goods to processing operations. The article discusses, in addition to the principles constituting the inward processing procedure, also six ways of implementing this procedure and the criteria for meeting subjective and objective conditions, as well as conditions related to customs control and economic conditions when issuing customs permits. It also presents the rules for determining the amount of import duties for processed products and the centralized EU INF SP system, which provides administrative and standardized exchange of information between economic operators and customs authorities, and between the customs authorities themselves participating in inward and outward processing customs procedures.

Problematyka badawcza artykułu koncentruje się na zasadach konstytuujących procedurę uszlachetniania czynnego w obrocie gospodarczym. O ile zgodnie z zasadą ogólną wyboru procedury każdy zgłaszający może wybrać procedurę celną, którą będą objęte towary, na warunkach przewidzianych dla tej procedury, bez względu na rodzaj, ilość, państwo pochodzenia, wysyłki lub przeznaczenia towarów, o tyle zasadniczym celem tej procedury jest poddanie towarów operacjom przetwarzania. W artykule omówiono – oprócz zasad konstytuujących procedurę uszlachetniania czynnego – także sześć sposobów realizowania tej procedury, kryteria spełnienia warunków podmiotowych i przedmiotowych oraz warunków związanych z kontrolą celną i warunkami ekonomicznymi przy wydawaniu pozwoleń celnych. Przedstawiono również reguły ustalania kwoty należności celnych przywozowych dla produktów przetworzonych oraz scentralizowany unijny system INF SP, który zapewnia administracyjną i ujednoliconą wymianę informacji między przedsiębiorcami a organami celnymi oraz między samymi organami celnymi uczestniczącymi w procedurach celnych uszlachetniania czynnego i biernego.
