Przedmiotem niniejszego opracowania uczyniono wybrane aspekty kontroli zarząd-czej, którą ustawa – prawo o ustroju sądów powszechnych przekazała w ramach wy-konywanego nadzoru administracyjnego nad sądami powszechnymi – Ministrowi Sprawiedliwości. Autorka próbuje odpowiedzieć na pytanie, czym jest kontrola za-rządcza, jaką rolę odgrywa dyrektor sądu w jej wykonywaniu. Zastanawia się rów-nież nad charakterem prawnym komunikatu Ministra Sprawiedliwości i komunikatu Ministra Finansów wydawanych w ramach kontroli zarządczej, oceniając ich rzeczywisty wpływ na regulacje prawnie wiążące w sądach powszechnych.

The main purpose of this paper is to present the important aspects of management con-trol over polish common courts. This type of control has been introduced by the Act on common courts system as a kind of administrative supervision over common courts and has been entrusted to the Minister of Justice. The Author of this paper deliberates what the management control is and what the character and duties of the director of a com-mon court are in this process. The Author also describes differences in legal nature be-tween the notice of the Minister of Justice, and the notice of the Minister of Finance. They both are issued in the process of management control, but their actual impact on common courts is different.
