An appeal is an institution that is well known and is often used in litigation. However, the legislator also provided an incidental appeal, which may be filed by the defendant after being notified of the main appeal. The subject of this article is the analysis of the functioning of this institution in the ordinary litigation process, as well as in proceedings for nullity of marriage. These considerations include both theoretical issues related to the proper understanding of the incidental appeal, as well as special situations: the possibility of a litigation party changing its position, challenging the title by the defendant or the possibility of an incidental appeal by the defender of the marriage bond.

Apelacja jest instytucją dobrze znaną i często stosowaną w procesach kościelnych. Ustawodawca przewidział jednak również apelację wpadkową, którą może zgłosić strona przeciwna, po tym jak zostanie powiadomiona o apelacji głównej. Przedmiotem niniejszego artykułu stała się analiza funkcjonowania tej instytucji w zwyczajnym procesie spornym, a także w procesach o nieważność małżeństwa. Rozważania te obejmują zarówno zagadnienia teoretyczne, związane z właściwym rozumieniem instytucji wpadkowej, jak również sytuacje szczególne, takie jak możliwość zmiany stanowiska przez stronę procesową, wniesienia tytułu nieważności małżeństwa przez stronę pozwaną czy możliwości zgłoszenia apelacji wpadkowej przez obrońcę węzła małżeńskiego.

In 1983 Code of Canon Law, the legislator has concluded the new title of nullity of marriage – incapability of causes of a psychic nature. The scope of this title including also the incapacity arising from the senile personality. Article was devoted to explaining the notion of senility, indication of disorders associated with senility and their influence on the ability to contracting marriage. Senile personality is often a effect of nervous system diseases, particularly of the brain, therefore it would be desirable by declare cases for the nullity of marriage, to seek assistance of experts in the field of psychology, whose opinion will helpful in preparation of the definitive sentence.
