The subject of this article is an analysis of the legal regulations on offences relating to the regaining of liberty by a person legally deprived of it in Italy, France and Spain. The author discusses the provisions relating to the offence of the escape of a person deprived of their liberty, the offence of assistance to escape and the offence of failure to return to a place of isolation after the time limit for allowing the person to leave the place temporarily. Similarities and differences between the solutions adopted in individual countries of the Roman legal culture, as well as between these solutions and the regulations contained in the Polish Criminal Code, are discussed. The analysis carried out led the author to formulate several de lege ferenda postulates.

Przedmiotem artykułu jest analiza regulacji prawnych dotyczących przestępstw związanych z odzyskaniem wolności przez osobę prawnie jej pozbawioną obowiązujących we Włoszech, Francji i Hiszpanii. Autor omawia przepisy typizujące przestępstwo ucieczki osoby pozbawionej wolności, przestępstwo udzielenia pomocy w ucieczce oraz przestępstwo niepowrócenia do miejsca izolacji po upływie terminu zezwolenia na czasowe opuszczenie tego miejsca. Omówione zostały podobieństwa i różnice pomiędzy rozwiązaniami przyjętymi w poszczególnych państwach romańskiej kultury prawnej, a także pomiędzy tymi rozwiązaniami a regulacjami zawartymi w polskim Kodeksie karnym. Przeprowadzona analiza doprowadziła do sformułowania kilku postulatów de lege ferenda.
