Artykuł stanowi próbę odpowiedzi na pytanie o znaczenie orzeczenia Trybunału Sprawiedliwości dotyczącego interpretacji pojęcia „ruchu pojazdu” w odniesieniu do pojazdów pełniących dwie funkcje: środka komunikacji i narzędzia pracy. Z uwagi na przyjętą w polskim prawie klasyfikację pojazdów mechanicznych będą to pojazdy wolnobieżne i ciągniki rolnicze. Interpretacja pojęcia „ruchu pojazdu” ma kluczowe znaczenie dla ustalenia istnienia i zakresu odpowiedzialności ubezpieczycieli odpowiedzialności cywilnej, jako że stanowi on przesłankę odpowiedzialności sprawczej. Uwzględniając zasadę akcesoryjności odpowiedzialności ubezpieczyciela poddano analizie wpływ interpretacji pojęcia „ruchu pojazdu” na zakres ochrony ubezpieczeniowej, wynikającej z obowiązkowego ubezpieczenia OC posiadacza pojazdu mechanicznego.

The present article is an attempt to answer the question about the importance of the judgment of the Court of Justice of the European Union regarding the interpretation of the concept of "use of vehicles" in respect of vehicles performing two functions, namely a means of transport and a production tool. In view of the classification of motor vehicles adopted in Polish law they are slow-moving vehicles and agricultural tractors. The interpretation of the term "use of vehicles" is vital to determine the existence and scope of liability of civil liability insurers, as it is a prerequisite of causative liability. Taking into account the principle of the ancillary nature of the insurer's liability, the author analyses the impact of the interpretation of the concept of "use of vehicles" on the scope of insurance coverage under compulsory liability insurance of the owner of a motor vehicle.
