W Polsce funkcjonuje ubezpieczeniowy model systemu ochrony zdrowia. Domi-nującym źródłem finansowania systemu zdrowotnego jest publiczne ubezpieczenie zdrowotne. Narodowy Fundusz Zdrowia finansuje świadczenia zdrowotne na pod-stawie umów zawartych ze świadczeniodawcami. Określone prawem metody finan-sowania świadczeń zdrowotnych to: stawka kapitacyjna, cena jednostkowa i ryczałt. Celem artykułu jest przedstawienie normatywnych metod (sposobów) finansowania świadczeniodawców medycznych

An insurance model of the health care system operates in Poland. Public health insurance is the dominant source of financing the health system. The National Health Fund finances health services on the basis of contracts concluded with healthcare providers. The methods of financing health services defined by law are: capitation rate, unit price and lump sum. The aim of the article is to present normative methods (ways) of financing medicalproviders.

Claims of patients against medical providers are increasingly common. In addition to the judicial mode from 1 January 2012, patients can also benefit from the administrative mode their claims. This is possible thanks to the regulations of the Act of 6 November 2008 on the rights of the patient and the patient’s Ombudsman (Section 13a). As a result of new legal solutions injured patient can also redress in administrative mode, ie when applying the findings of the medical event to voivodeship commission for adjudication of medical events. This article presents the regulations related to the potential claims of patients in administrative mode, before the voivodeship committees for the adjudication of medical events. Obecny rząd przygotowuje istotną reformę systemu ochrony zdrowia. W Polsce funkcjonuje obecnie ubezpieczeniowy model ochrony zdrowia. Płatnikiem jest Narodowy Fundusz Zdrowia. W 2018 r. model ubezpieczeniowy ma zostać zastąpiony przez model budżetowy (podatkowy). Ochrona zdrowia ma być finansowana z budżetu państwa i dostępna dla wszystkich. Zmiana modelu systemu ochrony zdrowia stanowi powrót do czasów PRL. W artykule przedstawiono możliwe europejskie modele ochrony zdrowia, a także obecny model polski. W artykule zawarto wybrane uwagi krytyczne w zakresie planowanej zmiany modelu ochrony zdrowia w Polsce. Uwagi dotyczą m.in. dostępności do świadczeń oraz ich finansowania. Słowa kluczowe: system, ochrona zdrowia, reforma, ubezpieczenia, podatki.

The present government is preparing a major reform of the healthcare system. Currently, Poland has an insurance-based health care model. The payer is the National Health Fund. In 2018, the insurancebased model will be replaced by a budget (tax)-based model. Health care will be financed by the state budget and will be available to everyone. Changing the model of the health care system is a return to the times of the Polish People’s Republic. The article presents possible European models of health care and the current Polish model. The article includes selected critical comments regarding the planned change of the health care model in Poland. The comments relate to, among others, access to services and their financing.

Advertising is closely related to the existence of the market, the essence of which is the exchange of goods and services. The law sometimes interferes with some areas leading to the reduction of the possibility of advertising a service or product. In many countries, including Poland, among others, advertising medical activity is prohibited. The purpose of this article is to present legislation and issues related to the advertising of health services (medical activity).
