In response to questions from the managing team of the Chancellery of the Sejm’s he author of the opinion claims that an entity which carries out professional lobbying activities and whose representatives are lobbyists registered in the Sejm, has a right to submit petition addressed to the Sejm concerning amendment of an act connected with their actions as the entity who carries out professional lobbying activities. A person who carries out professional lobbying activities and a person who is entitled to represent the entity which carries out such activities may attend sittings of the Committee on Petitions’ sitting upon an invitation of the committee’s presidium’s or a chairperson.

The bill provides for the introduction into the Polish legal order of a new private law institution, i.e. the family foundation, the aim of which is to accumulate family wealth allowing capital to be retained in the country for many generations and increasing the potential for domestic investment. The beneficiaries of the foundation can be natural persons (including the founder) and non-governmental organisations carrying out public benefit activities, specified in the statutes by the founder. The bill also sets out mechanisms for the termination of a family foundation and its liquidation, which are similar to the solutions known in commercial companies’ law.

The authors of the petition postulate an amendment to the act by introducing a ban on the production and sale in Poland of food products containing carcinogenic palm oil. In the opinion of the author, the postulate to introduce a total ban on the production and sale of food products containing palm oil in the Republic of Poland seems too far-reaching. However, it is worth to consider introducing rules that would contribute to limiting the content of this oil in food products.

The article discusses the most important issues related to conducting business activities by a family foundation. The first chapter indicates the purpose of introducing a new institution of Polish law – the family foundation. It is primarily to ensure multi-generational succession in family businesses, to accumulate family assets and effectively manage them as well as to provide benefits to beneficiaries. The second chapter attempts to discuss the individual types of business activities that the legislation permits a family foundation to conduct in Article 5 of the Family Foundation Act. The third chapter presents issues related to conducting business activities by a family foundation that go beyond the catalogue contained in Article 5 of the Family Foundation Act, and also indicates the legal consequences of conducting such business activities. The last chapter contains conclusions that may contribute to eliminating some interpretational doubts that may arise when applying Article 5 of the Family Foundation Act, which will be crucial when determining the amount of tax liabilities.

W artykule zostały omówione najważniejsze zagadnienia związane z prowadzeniem działalności gospodarczej przez fundację rodzinną. W pierwszym rozdziale wskazano na cel wprowadzenia nowej instytucji prawa polskiego – fundacji rodzinnej. Jest nim przede wszystkim zapewnienie wielopokoleniowej sukcesji w przedsiębiorstwach rodzinnych, gromadzenie rodzinnego majątku oraz efektywne zarządzanie nim, a także spełnianie świadczeń na rzecz beneficjentów. W drugim rozdziale podjęto próbę omówienia poszczególnych rodzajów działalności gospodarczej, na które ustawodawca zezwolił fundacji rodzinnej w art. 5 ustawy o fundacji rodzinnej. W trzecim rozdziale przybliżono kwestie dotyczące prowadzenia przez fundację rodzinną działalności gospodarczej wykraczającej poza katalog zawarty w art. 5 u.f.r., a także wskazano na konsekwencje prawne prowadzenia takiej działalności gospodarczej. W ostatnim rozdziale zostały zamieszczone wnioski, które być może przyczynią się do usunięcia niektórych wątpliwości interpretacyjnych, pojawiających się przy stosowaniu art. 5 u.f.r., co będzie miało kluczowe znaczenie dla określenia wysokości należności podatkowych.
