It is, as Deleuze and Guattari observed, “an ordinary sight in those days,” an indispensable part of full modernity, an image that is always within the range of sight. “A horse falls down in the street!,” “a horse is going to die.” From the Auguries ... of William Blake, from Hogarth's second stage of cruelty, through laments of Dostoyevski, up to the madness of Nietzsche and Little Hans’ phobia—the image is always there. It becomes “a hieroglyph that condenses all fears, from unnamable to namable.” Taking famous Freudian Analysis of a Phobia in a Five-year-old Boy as a starting point, we shall try to revise it as well as its famous Lacanian and Deleuzian reinterpretations. We shall invoke Agamben’s concept of “bare life” to reconsider an animal life that is tormented and eventually destroyed

Street art w służbie rewolucji

The purpose of this study was to outlines the essential characteristics and the genesis of one of the fastest growing area of contemporary art- street art. Stressing the uniqueness and conditions that make it so versatile shows how it is incorporated in the areas of the Middle East. Street art mainly due to its presence in public space and high social engagement of artists creating it becomes the perfect channel of expression of public sentiment. The study reveals a very dynamic process of spreading the idea of graffiti and use of this form of expression during the course of the Arab Spring. The description of the examples of street art as an expression of opposition to the prevailing regimes proves that graffiti and other forms of street art can be a important tool in the fight against oppression, and by the lack of censorship, makes it a tool accessible for almost everyone.

In the following article the issue of the purpose of the Act of 15 December 2016 on prevention of the unfair misuse of competitive advantage in the trade in agricultural and food products has been described. The article attempts to answer the query concerning the cohesion of those purposes, complementarity and the conflict in their structural assumptions. Apart from enumerating and discussing the purpose of adopting this act, the case law has been presented which enables to estimate if the presented purposes are the ones which are implemented in the process of executing the law. The subject of the article are not only the practical issues connected with the basic assumptions implemented in the Polish legislation but also the comparative law analysis, how other nationalities defi ne the purposes of their laws concerning the prevention of the unfair misuse of competitive advantage, but also estimating the level of their harmonisation with the EU competition law. In the summary of the article conclusions and the final evaluation of the purposes of the legislature were presented.

W niniejszym opracowaniu opisana została problematyka celów ustawy z 15.12.2016 r. o  przeciwdziałaniu nieuczciwemu wykorzystaniu przewagi kontaktowej w  obrocie produktami rolnymi i spożywczymi. Artykuł stanowi próbę odpowiedzi na pytanie o spójność tych celów, komplementarność oraz kolizje w ich strukturalnych założeniach. Oprócz wyliczenia i omówienia celów uchwalenia ustawy, zostało zaprezentowane dotychczasowe orzecznictwo, co pozwala na późniejszą ocenę, czy deklarowane przez prawodawcę cele są celami rzeczywistymi, realizowanymi w procesie stosowania ustawy. Przedmiotem rozważań są zatem zagadnienia praktyczne związane z wykładnią podstawowych założeń wprowadzonych w polskim ustawodawstwie. Artykuł zawiera także analizę prawnoporównawczą – w jaki sposób inne państwa defi niują cele swoich ustaw przeciwdziałających nieuczciwym praktykom handlowym, a także opis poziomu ich harmonizacji z unijnymi przepisami prawa konkurencji. W podsumowaniu niniejszego opracowania zostały zaprezentowane wnioski i końcowa ocena przyjętych przez ustawodawcę celów.
