The article attempts to provide a systemic approach to the grounds for refusal to perform notarial acts. The considerations began with determining the legal status of a notary public, which was necessary to define the function of refusal to perform a notarial act. Next, the author distin-guished a notarial act from a legal act documented by it and focused on presenting the sanctions of defectiveness of legal acts. Provisions providing for obligatory and optional grounds for refusal to perform a notarial act have been distinguished. This made it possible to express a general principle according to which the obligation to refuse to perform a notarial act depends on the ty-pe of sanction of defectiveness documented by a notarial deed of a legal act.
