It has been more than thirty years since, in the pages of “Państwo i Prawo” (State and Law), together with Professor Andrzej Stelmachowski, who is not with us anymore, we formulated the principles of agricultural law for the young, developing discipline of Juridical Science, i.e. for the agricultural law. Dynamic development of the agricultural law in the previous political formation (also continued in the free–market economy) required the formulation of specific guiding principles of this discipline of Juridical Science. The passage of time, the political transformation that took place in Poland after 1989 as well as Poland’s membership in the European Union require verification of the formulated principles of agricultural law. Existing agricultural law as well as the legislation of the European Union and national legislation allow the formulation of new principles of agricultural law and ranking them according to the importance of legal regulation. They include: 1. The principle of intervention impact on agriculture and rural areas by the European Union and nation states in accordance with the objective of the EU Common Agricultural Policy. 2. The principle of productivity including the stimulation of technical and agricultural as well as biological progress by the state. 3. The principle of protection of the productivity of land within the frameworks of the protection of natural resources in conjunction with development of spatial rural areas. 4. The principle of protection of the farm as a farmer’s workshop and of the protection of other forms of land management.

The article presents the problem of the intertemporal effect of the amendment of the Act of 26 June 2009 on the amendment of the law on land registers and mortgage and certain other acts. The introduced intertemporal regulations directly indicate that since the date of entry into force of the Act (Art. 14), i.e. 20 February 2011, there exist three varying legal systems concerning land registers. Entering into force of the above-mentioned amendment, i.e. the Act of 26 June 2009, is fundamental from the point of view of the application of both existing regulations and new ones, especially those concerning the contractual mortgage – both ordinary and capped. The date of 20 February 2011 constitutes a significant caesura which is used for determining whether the existing regulations or the new ones are applied.

W artykule wskazano problematykę skutku intertemporalnego (międzyczasowego) nowelizacji ustawy z dnia 26 czerwca 2009 r. o zmianie ustawy o księgach wieczystych i hipotece oraz niektórych innych ustaw. Wprowadzone przez powyższą nowelizację zasady intertemporalne jednoznacznie wskazują, że od 20 lutego 2011 r., tj. od daty wejścia w życie ustawy (art. 14), w obrocie prawnym funkcjonują trzy zróżnicowane systemy prawne dotyczące hipotek. Wejście w życie powyższej nowelizacji, tj. ustawy z dnia 26 czerwca 2009 r., ma istotne znaczenie z punktu widzenia stosowania przepisów dotychczasowych lub nowych po nowelizacji, w szczególności do hipoteki umownej – zwykłej i kaucyjnej. Istotną cezurą czasową dla określenia, czy stosuje się przepisy dotychczasowe czy też nowe, jest data 20 lutego 2011 r.

Le considerazioni svolte si concentrano sui metodi di studio del diritto, che il Professor Andrzej Stelmachowski ha sviluppato nell’ambito del diritto agrario. Questo eccezionale avvocato civilista e co-creatore del diritto agrario come ramo separato all’interno del sistema giuridico si è avvalso dei metodi che hanno influenzato le scuole filosofiche dedite alla metodologia riguardante lo studio in oggetto, vale a dire la scuola positivista, giuridico-naturale e storico-giuridica. Il Professor Stelmachowski, prendendo spunto dalla metodologia menzionata, ha creato un interessante conglomerato di metodi che analizzano il fine dellanorma giuridica, permettono di svolgere un esame empirico del diritto in azione e di effettuare un’analisi storica e giuridica dell’evoluzione degli istituti giuridici. Il metodo ad ampio spettro di studio, adottato dal Professore, ha portato a creare una metodologia specifica per lo studio del diritto agrario. È un importante contributo alla dottrina del diritto in questione in Polonia.

The deliberations are devoted to the methods of legal research that Professor Andrzej Stelmachowski conducted in the field of agricultural law. This outstanding civil lawyer and co-creator of agricultural law as a separate branch within the system of law used methods that shaped the philosophical schools of law research methodology, that is, the positivist, natural law and historical law school. Using the methodology of these schools, Professor Stelmachowski created an interesting conglomerate of methods of studying law through the analysis of the purpose of a legal norm, the empirical study of law in action and the historical and legal analysis of the evolution of legal institutions. The multithreaded method of legal research adopted by Professor Stelmachowski created a specific methodology of agricultural law research, which constitutes a significant legacy of the doctrine of agricultural law in Poland.

Rozważania poświęcone są metodom badania prawa, które Profesor Andrzej Stelmachowski prowadził w zakresie prawa rolnego. Ten wybitny prawnik cywilista i współtwórca prawa rolnego jako odrębnej gałęzi w ramach systemu prawa posługiwał się metodami, które ukształtowały filozoficzne szkoły metodologii badania prawa, takie jak szkoła pozytywistyczna, prawno-naturalna oraz historyczno-prawna. Profesor Stelmachowski, korzystając z metodologii tych szkół, stworzył interesujący konglomerat metod badania prawa poprzez analizę celu normy prawnej, empiryczne badanie prawa w działaniu oraz historyczno-prawną analizę ewolucji instytucji prawnych. Przyjęta przez profesora wielowątkowa metoda badania prawa stworzyła swoistą metodologię badania prawa rolnego. Stanowi ona istotny dorobek doktryny prawa rolnego w Polsce.

L’articolo presenta le principali fasi dell’evoluzione della compravendita degli immobili agricoli in Polonia dopo il 1989. In più, le considerazioni si incentrano sugli strumenti giuridici di base concernenti le trasformazioni proprietarie. È stata inoltre valutata l’evoluzione delle funzioni svolte dai soggetti che si occupano di compravendita di immobili agricoli in Polonia. Sono state indicate varie possibilità di formare il modello dell’agricoltura polacca a seconda delle regole adottate per la gestione della proprietà statale, inclusa la privatizzazione e la locazione. Infine, è stato valutato l’impatto delle autorità pubbliche sulla compravendita di immobili agricoli privati nel contesto delle regolazioni europee.

The article presents the main stages of the evolution of the transactions involving agricultural real estate in Poland after 1989. The focus is on the basic legal instruments applicable to ownership transformation. The evolution of the functions of legal entities dealing with agricultural real estate trading in Poland has also been assessed. Various possibilities of shaping the model of Polish agriculture have been proposed, depending on the adopted rules of managing state property, including privatisation or lease. Finally, the impact of public authorities on the trading in private agricultural real estate has been assessed in the context of European regulations.

W artykule przedstawiono główne etapy ewolucji obrotu nieruchomościami rolnymi w Polsce po 1989 r. Ponadto rozważania koncentrują się na podstawowych instrumentach prawnych dotyczących przekształceń własnościowych, autorzy ocenili także ewolucję funkcji podmiotów zajmujących się obrotem nieruchomościami rolnymi. W rozważaniach pokazane zostały różne możliwości kształtowania modelu polskiego rolnictwa w zależności od przyjętych zasad gospodarowania majątkiem państwowym, w tym prywatyzacji czy dzierżawy. Określony został też wpływ władz publicznych na obrót prywatnymi nieruchomościami rolnymi w kontekście regulacji europejskich.

The subject of thorough analysis is, among others, the effectiveness of the performed transformation and one of the first attempts, in Polish science, to compare the legal changes; the attempt to answer the research question concerning the method of the implemented changes – whether the administrative and legal regulation has brought the expected results and whether all legal institutions relevant to the private law have been used appropriately; results and method of the performed inspection and supervision of the process of ownership changes in both of the countries in question. One of the basic purposes is to answer the question of how the national administration interfere in the legal turnover of agricultural real estate nowadays and how the national agricultural property influences the legal turnover of real estate. The analysed legal regulations of both countries become an interesting research area. In both cases the process of ownership changes began similarly but the further changes were proceeding differently; also, the ultimate result of the system transformations is different. The execution of the project enabled to reveal advantages and disadvantages of the changes implemented during the last 20 years. It also enabled to suggest de lege ferenda changes in the Polish Law, which made it possible to reasonably manage the agricultural real estate being the property of the State Treasury, including the transformations of the Agricultural Property Agency.

In the article chosen issues of the relation of the Polish and the European agricultural law in basic concepts were presented. They made an appraisal of the need of the redefinition of these notions. In conclusion, it was found that only changes of a basic concepts may make it necessary to formulate a new agricultural legislation in a European perspective. They pointed also at issues of sending back legal for European regulations. They also dealt with linguistic issues and interpretation of formulated notions. It was emphasized, that the concepts of agricultural legislation contained in European law are concepts national law of particular importance. They are not only modifying already existing notions, but also, when the contradiction is occurring between them they are more important and should be applied in the given area of the regulation.

Professor Walerian Pańko in his two works, „The right of property and its present functions” and „Ownership of land space in the planned economy” recognizes the concept of property and its protection as a key to planning. This belief is also divided today, when ownership and functions have been modified, but the principles of planning meet other tasks. The views of this eminent professor of law who has the visionary talent will provide a starting point for discussion about the contemporary importance of planning for rural areas and the impact of spatial planning through the lens of ownership completed their functions. The authors seek to answer the question of whether the views presented more than thirty years ago, in a different economic and legal systems, spatial planning are still applicable? The answer to this question may help to use the modern legislator of the solutions proposed by Walerian Pańko in the field of space. The authors show that the majority views of the Walerian Pańko are still topicality.

Economic analysis of a farm allows to identify all basic elements of production factors which are characteristic to farms. The elements include property (predominantly land), capital, work and organization. From the legal point of view, a farm is a basic institution of agricultural law which is described by a number of definitions depending on the underlying norms for the legal regulations. On the one hand certain definitions are based on the civil law and include assets, but on the other hand the legislators use the notion of farm to define separate issues including marketing control, taxation, retirement benefits and pensions or other social welfare issues. Several basic definitions of farm may be found in Polish and European legislation. Noticeable differences between the above definitions bear significant legal implications. Therefore, the question how to define a farm becomes somewhat problematic. Several concepts and solutions are not satisfactory. However, one of them seems to be most appropriate. A farm is defined as assets of estate. This definition facilitates the security of business transactions and encourages development of business activity in agricultural sector. Trading a farm, which is an assets of estate, is in accordance with the legal regulations in force including civil law and agricultural law regulations.

The authors present the results of the research project „The Impact of Structural Funds to increase the competitiveness of Polish agriculture.” They analyze the competitiveness of Polish regions from the point of view of Polish agriculture by examining the effectiveness of the Structural Funds, the allocation of economic process and the legal and organizational framework of the Rural Development Programme (RDP). They note that their research is limited to the analysis only to a part of the Structural Funds which support Polish agriculture. The study, which included analysis of the consistency of the laws governing the RDP, at the initial stage, show not only practical economic effects of the disposal of funds, but also show the possible directions of changes in Polish law aimed at more appropriate and efficient disposal of agricultural administration of the Structural Funds.
