Pozytywizm aksjologiczny. Formuła Radbrucha a odpowiedzialność za wykonanie rozkazu przed międzynarodowymi trybunałami karnymi

The article presents the basic theses that make up the philosophical-legal concept laid out after World War II by Gustav Radbruch, with particular emphasis on the idea of so-called statutory lawlessness. In particular, the authors address the nature of modern positivism and its relationship to legal-natural concepts. They then discuss practical examples of the application of G. Radbruch’s thought in the decisions of selected tribunals established in the 2nd half of the 20th century to try crimes against humanity. The authors show that the mere fact of appealing to extra-legal values does not conflict with contemporary positivism. Moreover, the correlation of state law with axiology is inherent in contemporary dominant legal-positivist concepts.

W artykule przedstawiono podstawowe tezy składające się na koncepcję filozoficznoprawną wyłożoną po II wojnie światowej przez Gustawa Radbrucha, ze szczególnym uwzględnieniem idei tzw. ustawowego bezprawia. W szczególności autorzy podejmują temat natury współczesnego pozytywizmu oraz jego relacji wobec koncepcji prawnonaturalnych. Następnie omówione zostały praktyczne przykłady zastosowania myśli G. Radbrucha w postanowieniach wybranych trybunałów, powołanych w 2. połowie XX w. do sądzenia zbrodni przeciwko ludzkości. Autorzy wykazują, iż sam fakt odwoływania się do wartości pozaprawnych nie stoi w konflikcie ze współcześnie pojmowanym pozytywizmem. Co więcej, korelacja prawa stanowionego z aksjologią jest nieodłącznym elementem dominujących obecnie koncepcji prawnopozytywnych.
