Mediacja, jako polubowna metoda rozwiązywania sporów, z roku na rok cieszy się coraz większą popularnością. Pozostaje jednak w zasadzie nieobecna w postępowaniach restrukturyzacyjnych i upadłościowych. Celem niniejszego artykułu jest przybliżenie głównych zalet postępowania mediacyjnego i możliwości wykorzystania mediacji jako alternatywy dla postępowań upadłościowych i restrukturyzacyjnych, a także jako narzędzia usprawniającego, ułatwiającego i skracającego przebieg postępowań insolwencyjnych.

Mediation, as an amicable method of dispute resolution, proves to be more attractive every year. However, it is almost absent in restructuring and bankruptcy proceedings. The purpose of this article is to introduce the main advantages of mediation and the possibility of using mediation as an alternative vehicle to bankruptcy and restructuring proceedings, as well as a tool to streamline, facilitate and shorten the course of insolvency proceedings.
