The principles of good legislation are inferred by the Constitutional Tribunal from Article 2 of the Polish Constitution. The exact understanding of the principles of legislative techniques and the principles of proper legislation should be regarded as a key to the process of lawmaking. The application of the principle of proper legislation, the rules and specific directives resulting therefrom should lead to objectives assumed by the legislator, which are: coherence, consistency and completeness of the legal system. In this article the author discusses the essence of the principle of proper legislation and its possible impact on the legal system. Therefore, the author points out the examples of currently binding provisions which violate the legislation standards. The author discusses as well the impact of this regulation on legal transactions.
