Refusal to perform a notarial deed is a very important instrument in the notarial practice. Obliga-tions arising from the need to refuse a notarial act arise from the same attitude that is required when performing notarial act. The primary duty of the notary is to assess whether there is a field for notarial action, and if there is not - information duties to clients are triggered. While notarial actions take place within the framework of so-called notarial proceedings, the mere refusal to perform a notarial action takes us beyond the area of notarial proceedings into court procee-dings.
