Activity connected directly with preventing results of environmental degradation that are negative for health creates for public authority a sphere of action which combines both environmental protection and health protection. Environmental protection is a legal term with its definition in Art. 3 of Environmental Protection Act of 27 April 2001. Direct connection between environmental protection and health protection finds its reflection in the Act of 28 July 2005 on medical care, health care, health care protection areas and health care communities (called the Act on health resorts). This article contains an analysis of legal conditions connected with awarding a community the status of a health resort, according to the provisions of the Act of 27 March 2003 on spatial planning and development, as well as to the provisions of the above mentioned Act on health resorts.

Niniejszy artykuł jest próbą przedstawienia problematyki ograniczeń swobody wykonywania działalności gospodarczej wprowadzanych ze względu na ochronę przyrody. W pierwszej kolejności analizie poddano istotne dla tych rozważań pojęcia przyrody i ochrony przyrody, a następnie odniesiono je do możliwości realizacji swobody działalności gospodarczej w Polsce według przepisów Konstytucji Rzeczypospolitej Polskiej. W ramach tej analizy nakreślono ogólne przesłanki wprowadzania ograniczeń w zakresie korzystania z konstytucyjnych praw i wolności oraz przesłanki odnoszące się wprost do wprowadzania ograniczeń z korzystania z wolności działalności gospodarczej. Ochrona przyrody, stosownie do tej analizy, może być rozumiana w kategoriach ważnego interesu publicznego, który stanowi materialną przesłankę wprowadzania ograniczeń swobody wykonywania działalności gospodarczej w Polsce.

The article aims at a brief analysis of the institution of restrictions in economic activity established because of nature protection reasons. Thus, firstly it is essential to describe the notions of nature and nature protection and relate them to the terms of conducting economic activity in Poland under the provisions of The Constitution of the Republic of Poland. Then, the analysis shows the conditions of restricting constitutional rights and freedoms in Poland, and freedom of conducting economic activity itself. Nature protection reasons can be understood in terms of important public interest which creates the material conditions to restrict freedom of conducting economic activity in Poland.
