W wyroku z 28 lutego 2013 r., sygn. II AKa 12/13, Sąd Apelacyjny w Szczecinie stwierdził, że jeżeli przestępstwa, które dotychczas tworzyły – w wyroku jednostko-wym bądź w wyroku łącznym – zbieg przestępstw, a rozeszły się w nowym wyroku do nowo utworzonych zbiegów przestępstw, to muszą utracić moc wszystkie dotychcza-sowe orzeczenia o łączeniu kar, dla których podstawę stanowił dotychczasowy zbieg przestępstw, a nie jedynie te rozstrzygnięcia łączne, które zostały ujęte w nowym wy-roku. Analiza przywołanego orzeczenia oraz przepisów bezpośrednio dotyczących po-ruszonego w nim zagadnienia, tj. w szczególności art. 85 k.k. oraz art. 569 § 1 k.p.k. i art. 575 § 1 k.p.k., doprowadziła autora publikacji do zgoła odmiennych wniosków. Stąd niniejszą glosę do wyżej wymienionego wyroku SA w Szczecinie należy traktować jako glosę krytyczną.

In the sentence of February 28th 2013 in the case II AKa 12/13 the Appeals Judge decided that if crimes creating a concurrence of crimes in a single sentence or former cumulative sentence, disbanded into different other concurrences, then all the previous cumulative punishment adjudgements lose their power, and not only the combined set-tlements that were formulated in the new sentence. The analysis of said settlement and regulations directly concerning the raised concern i.e in particular art. 89 k.k., 569 and art. 575 k.p.k. lead the author of the gloss to completely different conclusions. Thus the presented gloss concerning aforementioned sentence of the Appeals Judge should be considered critical.
