The paper deals with the issue of a notary's refusal to perform a notarial act and its legal consequences, as well as ways of documenting such refusal. First, it discusses the grounds and prerequisites of a nota-ry's refusal to perform an act, and then the principle and prerequisites of his/her liability. When analy-sing the liability of a notary for refusal to perform an action, three situations were presented: when the notary refuses to perform the action and the refusal is not challenged in court, when the notary refuses to perform the action and the refusal is challenged in court, when the notary refuses to perform the ac-tion, but it is performed by another notary.
