The article presents the institution of tax base estimation described in the Tax Ordinance Act, outlining its significance and the conditions of its application as well as estimation methods used by tax authorities. The article describes the broad spectrum of judgments of administrative courts on the tax base estimation, and brings attention to overly general legal regulations.

W artykule omówiono instytucję szacunkowego ustalania podstawy opodatkowania określoną w Ordynacji podatkowej, przedstawiając jej istotę oraz przesłanki zastosowania, a także metody ustalania stosowane przez organy podatkowe. Zaprezentowano szeroką linię orzeczniczą sądów administracyjnych w przedmiocie szacunkowego ustalania podstawy opodatkowania oraz wskazano na zbyt ogólnikowe regulacje prawne analizowanej instytucji.
