The subject of the article is a specific issue regarding enforcement carried out on the basis of the provi-sions of the Act on Enforcement in Administration, namely its initiation in relation to legal persons. The problem noticed by the authors concerns the impact on the admissibility of initiating and conducting en-forcement proceedings of the lack of a body of a legal person or deficiencies in the composition of its bodies authorized to represent. In the doctrine and jurisprudence, this issue is rarely the subject of a broader legal analysis, and it seems to be crucial for the proper conduct of enforcement proceedings. The lack of effective initiation of administrative enforcement from a legal point of view makes all en-forcement activities undertaken in such .proceedings. non-existent from a legal point of view. Therefo-re, this is an important issue both practically and theoretically. And the need to combine issues in the field of commercial law and administrative law is also a challenge for authors and people dealing with enforcement issues. After the analysis, the authors come to the conclusion that deficiencies in the autho-rities do not affect the possibility of initiating enforcement proceedings, but prevent the initiation of administrative enforcement.
