Przedmiotem artykułu są problemy związane z ubezpieczeniem społecznym osób wykonujących pracę na podstawie umów o świadczenie usług, do których stosuje się przepisy Kodeksu cywilnego o umowie zlecenia, zwanych na gruncie ubezpieczeń społecznych zleceniobiorcami. Sytuacja faktyczna zleceniobiorców jest zbliżona do sytuacji pracowników, niemniej istnieją pewne odrębności pomiędzy tymi dwiema grupami, które uzasadniają odmienne ukształtowanie zasad ubezpieczenia społecznego. W artykule przeprowadzono analizę obowiązujących regulacji prawnych i orzecznictwa sądowego na tle różnych sytuacji faktycznych. Przedstawione są również propozycje zmian legislacyjnych w zakresie ubezpieczenia społecznego zleceniobiorców.

The subject of the article are problems related to the social insurance of persons performing work on the basis of contracts for the provision of services, to which applicable are the provisions of the Civil Code on the mandatory agreements, referred to as social insurers. The actual situation of the contractors is similar to that of employees, though there exist certain differences between the two groups which fundamentally change the insurance principles in existence. The article analyzes the existing legal regulations and judicial decisions in relation to various factual situations. Proposals for legislative changes in the field of social insurance for contractors are also presented.
