Polityka wsparcia rodzin z osobami niepełnosprawnymi. W cieniu wyroków Trybunału Konstytucyjnego RP i protestów społecznych

The article aims to portray a reconstruction as well as conduct an analysis of the changes in public support policy for the people who provide long-term care to their heavily disabled relatives. The first part presents the characteristic traits of the carer allowance recipients as well as their experiences and distinctiveness in the broader context of the situation of the disabled and their families. The second part provides a chronology of the changes in financial support policy toward carers since 2003 when the Act of Family Benefits took effect. Under the Act carers are entitled to allowances up to the present time. The process shows not only the lack of any stable trend as far as the direction of the policy in that field is concerned, but also a big role of external factors as well as social and public actors in that matter. The actors of public policy in this area as well as their impact on the construct of the legal changes in place constitute the subject of the third part of the article. Apart from the Council of Ministers, the author regards the Constitutional Tribunal and its rulings, the Ombudsman and also public support recipients along with their representative parties as the actors of public support policy.

Artykuł stanowi rekonstrukcję i analizę procesu kształtowania się polityki wsparcia osób długoterminowo zajmujących się bliskimi niezdolnymi do samodzielnej egzystencji. W pierwszej części przedstawiono cechy omawianej grupy oraz pokazano jej doświadczenia i odrębności na szerszym tle sytuacji osób niepełnosprawnych, a także ich rodzin. W drugiej części dokonano periodyzacji zmian, jakie zaszły w systemie wsparcia pieniężnego omawianej grupy w okresie od początku wejścia w życie ustawy o świadczeniach rodzinnych, na mocy której do dziś wypłaca się świadczenia dla opiekunów. Ukazanie tego procesu dowodzi braku stałej tendencji, jeśli chodzi o kierunek kolejnych reform, natomiast dużej roli zewnętrznych wobec decydentów czynników oraz aktorów społecznych i publicznych. To owym aktorom polityki publicznej i ich wpływowi na kształt zmian prawnych poświęcono trzecią część artykułu. Autor wyróżnił wśród aktorów polityki wsparcia oprócz Rady Ministrów, także Trybunał Konstytucyjny i jego kolejne wyroki, Rzecznika Praw Obywatelskich oraz samych adresatów wsparcia i środowiska ich reprezentujące.

The article is about the contemporary agenda of the policy for senior citizens in Poland, concerning especially the long-term care issue. In the first part, there are key concepts of the article defined, such as “agenda in the public policy”, “policy for senior citizens” and long-term care issue”. In the second part, there are several policy documents and programmes for the aged examined, which provides the overview of the current elderly and long-term policy and its agenda. The analysis includes the governmental documents and programmes, as well as the activity (concerning long-term care for the elderly) of some other central institutions such as the Ombudsman and Supreme Audit Office and Office of Competition and Consumer Protection. The article ends with the conclusions.

Artykuł poświęcony jest współczesnej agendzie polityki senioralnej w Polsce w kontekście zagadnień związanych z opieką długoterminową i usługami opiekuńczymi wobec osób starszych. W pierwszej części definiowane są zasadnicze pojęcia jak „agenda”, „polityka senioralna” czy rozumienie „kwestii opiekuńczej”. W następnej części dokonano przeglądu dokumentów różnych podmiotów publicznych w zakresie działań na rzecz osób starszych pod kątem tego, czy i jak obecne są w nich zagadnienia związane z opieką. Na tej podstawie rekonstruowana jest agenda polityki senioralnej w aspekcie opiekuńczym. Najpierw omawiane są dokumenty i programy rządowe, a następnie działalność innych podmiotów, jak Rzecznik Praw Obywatelskich, Najwyższa Izba Kontroli czy Urząd Ochrony Konkurencji i Konsumenta. Artykuł wieńczą wnioski.

An article focuses on the policy of long-term care adressed to dissabled children and their informal carers. In fifi rst part author considers whether long-term care analysis should be used not only in case of the frail elderly people, but also disabled children and then considers why lots of scientififi c works and policy papers neglect the needs of children in the long-term context. In the second part author presents main institutions of public support for heaviliy disabled children and their parents. In that analysis the emphasis is put on the benefifi ts given to the families that care for the children themselves. Next, there are presented some projects of changes in long-term care. Those proposals show that children and edults demanding long-term care are often treated seperately in the reforms currently prepared. At the end, there is a conclusion and recomendations.

Artykuł poświęcony jest polityce w zakresie opieki długoterminowej wobec niepełnosprawnych dzieci i ich opiekunów. W pierwszej części autor pokazuje, że analiza opieki długoterminowej nie powinna być skoncentrowana wyłącznie na niedołężnych osobach starszych, ale także na niepełnosprawnych dzieciach. W drugiej części prezentuje główne instytucje i instrumenty publicznego wsparcia wobec głęboko niepełnosprawnych dzieci i ich rodziców. Szczególną uwagę położono na świadczenia kierowane do rodzin, które same opiekują się dziećmi. W artykule dokonano analizy projektu ustawy o pomocy osobom niesamodzielnym pod kątem tego, jak może poprawić sytuację dzieci niepełnosprawnych i ich opiekunów. Okazuje się, że w projekcie tym nie uwzględnia się niepełnosprawnych dzieci, co w opinii autora budzi wiele zastrzeżeń. Opracowanie kończy zbiór wniosków i rekomendacji.
