In accordance with the law on public procurement, the criteria for evaluation of offers submitted by contractors are the following: price or cost, or price or cost and other criteria related to the subject of procurement, such as quality, social, environmental or innovative aspects, as well as the organisation and experience of the persons who realise the procurement, and post-sale services and technical assistance. As a result of the implementation of the European law, which creates the so called socially responsible public procurement, in 2009 the law on public procurement was amended with the conditions related to the characteristics of the contractor (so called social clauses). In their article, the authors attempt to present the European and Polish legal regulations relating to the application of social clauses in public procurement, to find the reasons for low interest of the ordering parties in the use of social clauses, and to discuss good practices related to this solution.
