The Adversarial Principle in Non-litigious Proceedings: a Contribution to the Discussion Summary The adversarial principle has been applicable in Polish non-litigious proceedings since 1964, when the provisions for litigious and non-litigious proceedings in Polish civil law were integrated in one civil code, and later when its procedural law was fundamentally revised and amended. Prior to this change, the applicable provisions were defined in the 1945 Code for non-litigious proceedings, which did not admit the adversary system, viz. the principle that the parties to proceedings collect evidence and produce witnesses, while the court merely assists and supervises. There are only two situations in which under current Polish civil law the inquisitorial system may supersede the adversary ststem. The two exceptions are: 1) when ex officio proceedings may be initiated on the grounds of a legislative act; and 2) when it is in the public interest to initiate an ex officio inquiry.

This study explores the significance of the principles of salus animarum, the truth and adversarial system for the nullity of a marriage process. The salus animarum principle defines the supernatural purpose of canon law, therefore the principles of the nullity of a marriage process must be subject to it. The principle of knowledge of truth is a key to a nullity of marriage process that all participants of iudicium are to follow. The way how to show the truth is the base of marriage process on values arising from the adversarial system.
6 ust. 3 lit. d EKPC.

The contribution deals with the issue that is more and more resonant in the field of interrogation of witness in criminal proceedings not only at the level of legal theory but also at the level of application practice – it is the question of the need to respect the principle of contradictory within the realization of the abovementioned procedural act. In this context we are confronted with the requirement that the testimony of witnesses in criminal proceedings should have the so-called contradictory character which arises directly from Article 6 section 3 letter d of ECHR.
The principle of contradiction, called also principium contradictori, is the superior goal of all process activities, it is sine qua non of any contentious trial. It’s correct content is striving for objective truth by putting forward the opposite thesis. This is expressed in the utterance of thesis A by one of the subjects, while the other subject expresses the thesis non-A. Process activity in the context of the implementation of the contradiction principle is multidimensional. Obviously, this activity, due to technical difficulties in interpersonal relations because of pandemic, may have slightly reduced dynamics. Nevertheless, this should not have an impact on the contradictional dimension of the process. In some cases, we can note some procedural nuances, which can be discussed whether they are still what they should be, or whether they are no longer what they should be. In some situations, for example, the principle of directness may be slightly modified, as the online meeting of the parties in case with a judge, with poor internet transmission, may significantly affect the lack of diligence in reaching the objective truth. Also, the lack of emotions related to a personal meeting can have a big impact on it, which should be treated as a negative side of what the pandemic reality entails. Negative emotions in interpersonal relationships are usually assessed in an unambiguous way, however, they should be viewed from a different perspective, as they can be an incentive to act. Subjects moved by some fact activate their intellect and intensify their procedural activities, and on such an occasion it is possible to extract from them more facts that may contribute to the issuance of a fair judgment.

Among the particular branches of law, one can distinguish the so-called primary principles of law. They mirror the basic assumptions of a specific area of law. Adversarial principle is regarded as one of such principles within the field of civil proceeding. In the most general approach, the principle indicates the burden that rests on the parties – presenting factual situation and invoking evidence to support it. Under this rule, the cognition of civil court is limited solely to assessing the evidence introduced by parties and providing a suitable decision on this basis. Introduction of the adversarial principle ought to significantly contribute to creating a quick and efficient mechanism for bringing to justice based on evidence invoked by the parties. Winning the court case ought to constitute a reward for appropriate fulfillment of one’s law-imposed obligation to present rationale.

The adversarial principle can be considered as one of the indispensable principles of not only criminal proceedings but also proceedings integrated in other branches of national law of the Slovak Republic. So it is appropriate to recognize its important position and emphasize that its omission may have far-reaching consequences. Its importance underline also wide range sources of law. In practice, focusing primarily on criminal law, we encounter with its limitations, particularly from the perspective of the accused person in the ongoing criminal proceedings, especially by examination of witness whose identity must remain classified. The main aim of the article is to point out how the right of an accused person on adversarial examination of witness whose identity must remain classified can be guaranteed through the conditions which declares European Court of Human rights and which are required for the applicability a testimony of this witness as an evidence in criminal proceedings.

Komentowany wyrok Sądu Apelacyjnego w Szczecinie porusza istotny problem związany z domniemaniami dokumentu prywatnego.

The commented judgment of the court of appeal raises an important issue con-cerning presumptions of a private document. The presumptions of law associated with private documents (Art. 253 CCP), that is a presumption that a statement contained in a document comes from the person who signed it (Art. 245 CCP), as well as the presump¬tion of authenticity of the document (Art. 253 CCP) are rebuttable and can be contested by any means of proof. The commentary also discusses the issue of the burden of proof in the case of rais¬ing an objection of falsification of signatures contained in the document, while discuss¬ing situations when the burden of responsibility lies on the person intending to use the document, and when it does so on the denying person. Also, the issue of activity of the party in terms of evidence is touched upon as well as consequences of inaction in this regard. It was explained that the burden of proof is not dependent on the position that the party takes in the civil suit. This is independent of whet her a given entity is the claimant or the defendant, as it involves the obligation to demonstrate the circumstances that form the basis for a right conferred on a given entity. In fact, it is an “obligation” understood as the need to produce evidence by a party in their own interest. In the commented judgment the author also raises issues of the adversarial nature of Polish civil procedure, with particular emphasis on the situation when the party is represented by a professional representative, and the issue of admissibility of producing new facts and evidence before the court of second instance and of restrictions in place in this regard.
Whether or not an expert opinion issued for different proceedings can be used in civil proceedings has been the subject of much discussion in literature and jurisprudence. To settle this matter once and for all, one of the draft amendments of the Civil Code proposes a new provision – Article 2781 of Polish Code of Civil Procedure – to provide direct legal basis to admit opinions commissioned by public authorities in different proceedings conducted under the authority of an act of Parliament. This will make it possible to speed up the course and limit the costs of civil proceedings, and, thanks to prescribing some limitations relating to the basis for ordering such evidence (proceedings provided for by an act of Parliament) and the ordering body (a public authority), it will also guarantee that the principle of fair trial (due process) is upheld in relation to the expert’s impartiality.

The provisions of the Act - Industrial Property Law in respect to trademarks provide for proceedings regarding opposition to a trademark application, as well as proceedings for invalidation of the protection right. The aim of this study is to analyze selected regulations of the above-mentioned proceedings compared to the procedures in force before European Union Intellectual Property Office (EUIPO, and in particular showing the shortcomings of the procedures before the Polish Office. Such shortcomings include the separation of the application proceedings from the opposition proceedings, different treatment of these proceedings by the legislator, e.g. in terms of hearings, regulations on requesting proof of use of the mark that is the basis for the opposition.

Celem niniejszego opracowania jest analiza wybranych regulacji ww. postępowań w zestawieniu z procedurami obowiązującymi przed Urzędem Unii Europejskiej do spraw Własności Intelektualnej (EUIPO), a zwłaszcza pokazanie mankamentów procedur przed polskim Urzędem.
This article discusses the grounds for the dismissal of a party’s evidentiary motion in criminal proceedings, as defined in Art. 170 § 1 point 6 of Kodeks postępowania karnego (the Polish Code of Criminal Procedure) and brought into the Code by the amendment of 19 July 2019 (Ustawa z 19 lipca 2019 r. o zmianie ustawy – Kodeks postępowania karnego oraz niektórych innych ustaw; Dz.U. 2019, Item 1694). Under the amended article, an evidentiary motion may be dismissed also if it was submitted after the deadline set by the judicial body, of which the party submitting the motion was notified. The present study also considers the disposition of the amended Art. 170 § 1a, which offers the possibility of an evidentiary motion being dismissed if it was submitted after the deadline set by the judicial body, in a situation where it concerns the key circumstances from the point of view of the decision on criminal liability. I present the ratio legis for the amendment of Art. 170 § 1 point 6 and § 1a, and give a dogmatic analysis of these provisions as well as their assessment from the point of view of the axiology of criminal proceedings. I compare the new regulations with the set of key procedural principles currently in force, and offer a practicable interpretation of the new provisions.

Zaprezentowany artykuł poświęcony został statuowanej w art. 170 § 1 pkt 6 k.p.k. podstawie oddalenia wniosku dowodowego strony w procesie karnym, wprowadzonej do kodeksu postępowania karnego ustawą z 19 lipca 2019 r. o zmianie ustawy – Kodeks postępowania karnego oraz niektórych innych ustaw (Dz. U. poz.
The article presents a comparison of selected aspects of the judicial management of evidence hearing before a court of first instance in the Polish and Belgian systems of procedural law. It discusses the issue of ensuring the efficient management of evidence hearing, which is one of the major principles of civil proceedings in both discussed legal systems. The main role of the court in evidence hearing consists in supervising whether evidence reported by the parties is appropriate, verifying its admissibility and usefulness, interpreting and evaluating this evidence, and finally, in the possibility of taking steps ex officio in this respect. In both the Polish and Belgian civil procedure, the burden of proof is on the parties; however, it is the court that, being the manager of evidence hearing, also safeguards adherence to the principles of free exercise of rights, adversariness, and evidence concentration in a lawsuit. The possibility of admitting evidence ex officio, which is laid down in both legal systems, is to some extent limited in the Belgian one, which is directly expressed in the provisions. On the other hand, parties’ activity in the field of evidence presentation is more formalised in the Polish system. There are also major differences with respect to the misuse of procedural law. Although it has been statutorily defined in both countries, carries the penalty of a fine and imposes similar obligations on the court towards the parties to a lawsuit, in Poland, unlike in the Belgian system, there is no possibility of claiming compensation for the procedural law misuse by an opponent within the same proceedings.

Artykuł stanowi porównanie wybranych aspektów sędziowskiego kierownictwa postępowaniem dowodowym przed sądem pierwszej instancji w polskim i belgijskim systemie prawa procesowego.
