CEL NAUKOWY: Celem artykułu jest przedstawienie wyników badań z zakresu przeprowadzonej analizy na temat podstawowych problemów liberalizacji handlu międzynarodowego na forum WTO w kontekście przedłużającej się Rundy z Doha. PROBLEM I METODY BADAWCZE: W artykule zastosowano ilościową i jakościową analizę publikacji w języku polskim oraz w języku angielskim z zakresu norm w funkcjonowaniu organizacji międzynarodowej WTO oraz regionalnych ugrupowań integracyjnych. PROCES WYWODU: Analizę przedstawioną w artykule oparto w zasadniczej mierze na analizie jakościowej na temat skuteczności liberalizacji handlu międzynarodowego w WTO oraz poza WTO. WYNIKI ANALIZY NAUKOWEJ: Dorobek w literaturze polskiej z zakresu liberalizacji handlu w ramach Rundy z Doha jest zdecydowanie mniejszy niż w literaturze zagranicznej. Wieloletnie wielostronne negocjacje handlowe w ramach Rundy z Doha nie podważyły zdolności WTO do stanowienia forum liberalizacji handlu międzynarodowego. Osłabienie wielostronnych negocjacji handlowych Rundy z Doha wynika z zaangażowania się Stanów Zjednoczonych i Unii Europejskiej w liberalizację na forum regionalnych ugrupowań integracyjnych takich jak Partnerstwo Transpacyficzne (Trans‑Pacific Partnership – TPP) oraz Transatlantyckie Partnerstwo w dziedzinie handlu i inwestycji (Transatlantic Trade and Investment Partnership – TTIP). WNIOSKI, INNOWACJE, REKOMENDACJE: Należy pogłębić analizę na temat integracji „w głąb” w regionalnych ugrupowaniach integracyjnych w celach porównawczych z regulacjami WTO.

Celem artykułu jest przedstawienie pozycji Polski w handlu międzynarodowym i znaczenia rozwiązań we wspólnej polityki handlowej UE w zwiększeniu roli Polski w wymianie handlowej. W artykule omówiono czynniki określające obroty handlu międzynarodowego Polski: zmianę koniunktury w gospodarce światowej, rosnący protekcjonizm niektórych państw, konkurencyjność gospodarki Polski, zwiększenie liczby nowych umów o wolnym handlu zawartych przez Unię Europejską, a tym samym przez Polskę. W pracy zastosowano metodę jakościową i ilościową. Przyszłość wymiany handlowej Polski będą warunkować dążenia do liberalizacji handlu zagranicznego Unii Europejskiej, wyjście Wielkiej Brytanii z UE, jednostkowe nakłady pracy oraz konkurencyjność polskiego handlu zagranicznego.

The aim of the article is to present Poland’s position in international trade and the importance of the solutions applied in the common EU trade policy in increasing the role of Polish trade in international commercial exchange. The article discusses the factors determining the turnover of Poland’s international trade: a change in the global economy, growing protectionism of some countries, competitiveness of the Polish economy, an increase in the number of new free trade agreements concluded by the European Union, and thus by Poland, as one of the Member States. The article presents the findings of qualitative and quantitative analyses. The future of Polish trade will be conditioned by the pursuit of liberalization of the European Union’s foreign trade, the exit of the United Kingdom from the EU structures, individual labour inputs and the competitiveness of Polish foreign trade.

The article analyzes the benefits and costs of establishing the Transatlantic Partnership in the field of trade and investment for the United States, the European Union and third countries, in the context of theory of economic integration and WTO regulations. The following factors that increase the strength of the beneficial trade creation effect were analyzed: the place of the United States and the European Union in world trade, the importance of intra-regional trade in total trade, the share of sectors in the integration process, the level of customs duties before integration. The negative impact of TTIP for third countries was also examined. A The TIPP and WTO agreements were compared, particularly the attempts to regulate investor-state disputes in TTIP.

RESEARCH OBJECTIVE: The aim of the article is to examine the causes, effectiveness and possibilities of overcoming the crisis of the WTO dispute settlement system, including the Appellate Body, in conditions of weakening legitimacy for the functioning and acceptance of the World Trade Organization procedures. THE RESEARCH PROBLEM AND METHODS: The article uses the qualitative and quantitative method to analyze the controversies related to the functioning of the WTO Appellate Body. The theory of international organization and the theory of public choice were used to analyze the effectiveness of the Appellate Body’s operations in the field of dispute settlement procedures between states in international trade. THE PROCESS OF ARGUMENTATION: Based on the theory of international organization and the theory of public choice, the article discusses the issues of social legitimization for the creation and enforcement of WTO standards that allow the process of liberalization of international trade. Next, the effectiveness of the dispute settlement system, including the Appellate Body, is presented, which allowed the WTO to act in limiting protectionist actions by states. RESEARCH RESULTS: Scientific analysis has confirmed the effectiveness of the WTO dispute settlement system in terms of liberalizing international trade. The weakening social and normative legitimacy of the dispute settlement system, including the WTO Appellate Body, as a result of reduced support for the idea of free trade in many WTO member states, in particular in the United States, made it impossible to reform WTO rules. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: Further analysis should be carried out on scientific research on the reform of the dispute settlement system in regional solutions without the participation of the United States. It is also necessary to examine the increase in the level of protectionism in international trade as a result of blocking the activity of the Appellate Body.

CEL NAUKOWY: Celem artykułu jest zbadanie przyczyn, efektywności i możliwości wyjścia z kryzysu systemu rozstrzygania sporów WTO (World Trade Organization), w tym Organu Apelacyjnego w warunkach słabnącej legitymizacji dla funkcjonowania i akceptacji procedur Światowej Organizacji Handlu. PROBLEM I METODY BADAWCZE: W artykule zastosowano metodę jakościową i ilościową do analizy kontrowersji związanych z funkcjonowaniem Organu Apelacyjnego WTO. Do analizy efektywności działania Organu Apelacyjnego w zakresie procedur rozstrzygania sporów między państwami w handlu międzynarodowym zastosowano teorię organizacji międzynarodowej oraz teorię wyboru publicznego. PROCES WYWODU: Na podstawie teorii organizacji międzynarodowej i teorii wyboru publicznego w artykule omówiono problematykę legitymizacji społecznej dla tworzenia i egzekwowania norm WTO, pozwalających na proces liberalizacji handlu międzynarodowego. Następnie przedstawiono efektywność systemu rozstrzygania sporów, w tym Organu Apelacyjnego, która umożliwiła działanie WTO w ograniczeniu działań protekcjonistycznych państw. WYNIKI ANALIZY NAUKOWEJ: Analiza naukowa potwierdziła efektywność systemu rozstrzygania sporów WTO odnośnie do liberalizacji handlu międzynarodowego. Słabnąca legitymizacja społeczna i normatywna systemu rozstrzygania sporów, w tym Organu Apelacyjnego WTO, w wyniku ograniczenia poparcia dla idei wolnego handlu w wielu państwach członkowskich WTO, w szczególności w Stanach Zjednoczonych, uniemożliwiła reformowanie reguł WTO. WNIOSKI, INNOWACJE I REKOMENDACJE: W dalszej analizie należy podjąć badania naukowe dotyczące zreformowania systemu rozstrzygania sporów w rozwiązaniach regionalnych bez udziału Stanów Zjednoczonych. Niezbędne jest również zbadanie wzrostu poziomu protekcjonizmu w handlu międzynarodowym w efekcie zablokowania działalności Organu Apelacyjnego.
