The text refers to relations between freedom of speech and criminal law. It examines the ratio behind limiting the freedom of expression when personal psychological harm might occur. The inspiration is drawn from Professor Tomasz Kaczmarek’s works on the axiology of criminal law. The ratio of criminal law and ratio of democratic legal state is tested within freedom of speech. Article 196 of criminal law, among the others, is critically reviewed as far as its rationale for being included in the criminal law vis-à-vis Article 212 of criminal law and constitutional provisions confirming freedom of speech as the human right.

The study concerns religious feelings in preschool children as reported by the children and by their mothers. 90 children at the ages 4, 5 and 6 were studied by means of a picture method and interviews with their mothers were carried out. The paper includes a contents analysis of the representations of religious feelings in children as well as a comparison of the data from children and their mothers with the focus on both the contents and the way of expressing the feelings reported. The relationships between positive and negative feelings are discussed and more detailed statistical analysis was applied to negative feelings. It was found that on the level of general tendencies the both sources of reports concerning children's religious feelings showed similar quality. A more detailed analysis discovered certain minor differences, however, the data from the two sources were complementary rather than contradictory.

This article discusses the issue of offending religious feelings in the light of Polish penal code. It is an attempt at answering the question of whether the standards really protect the values they were supposed to protect when they were instituted. And if they do, to what extent? Is the protection of religious feelings in Poland real or is it just a formal and legal illusion? An analysis of art. 196 of the penal code, as well as existing view on this doctrine shows a number of variances in interpretation. This leads to a conclusion that religious feelings may be protected under constitution, but the protection seems largely illusory in practice. Apart from the legislative and legal reservations, the low level of protection of religious feelings seems to also stem from the existing public attitudes, including the acceptance of the progressing insensitivity to Christian symbols. This acceptance is only seemingly harmless. In fact, it depreciates the sacred character of such objects. This results in a certain blurring of the notion of insult towards the objects of religious worship.

The article highlights issues related to the offense of religious feelings in the context of the main symbol of Christianity: the cross. Feelings in general, including religious feelings, are not imaginary. They play an important role in the lives of both individuals and the community. They motivate a person’s moral choices. There is no religion without feelings. Above all, insulting religious feelings is an offense against religious freedom. A deliberate public insult to a believer’s feelings is a violation of the law. There are several ways to offend religious feelings relating directly to a believer and his or her worship activities as well as sacred places. The most important symbol of Christianity, the cross, is often used by certain circles hostile to religion in general and Christianity in particular, deliberately seeking to offend religious feelings. In this way, it becomes a favored object of offense that is easy to manipulate.

196 w Kodeksie karnym.

The offence against religious feelings has its roots in the offence of blasphemy against God, hence the religious ground of that regulation is undeniable. Considering the above, the imputation that the offence in question is an expression of secularity of the state and that it had nothing to do with religion, especially the Christian religion, should be rejected. Poland is not a confessional state, but in relations with religion it is in a relation of coordinated separation, an eminent example of which is including Art. 196 in the Criminal Code.

Celem niniejszego artykułu jest analiza wybranych aspektów konfliktu między dwoma podstawowymi wartościami: wolnością ekspresji i wolnością religii. W oparciu o tak zwaną sprawę Aiisy (zob. wyrok Europejskiego Trybunału Praw Człowieka z dnia 22 lipca 2021 r., Ana Gachechiladze v. Georgia, skarga nr 2591/19) autor proponuje generalne kryteria oceny obrazy uczuć religijnych.

The present article aims to analyze selected aspects of the conflict between two basic values: freedom of expression and freedom of religion. Based on the co-called Aiisa’s case (see the judgement of the European Court of Human Rights of 22 July 2021, Ana Gachechiladze v. Georgia, App. No. 2591/19), the paper proposes general criteria for assessing insults to religious feelings. It is argued that national courts must not act as guardians of concrete religious groups or conventional morals, as this leads to negative results and destruction of the national law system. As a rule, it cannot be excluded that sacred images and figures are used in commercials or other ways of expression. When adjudicating on a case, every court should primarily consider the context, content and form, and prohibition of expression should be the last and final resort.

Man is identified by both material and immaterial factors, including religious feelings, determining his individual attitude to the object of worship, but also determining his way of life. Religious feelings relating to a special relationship with the object of worship, which deserves reverence and respect, are very often violated by words, gestures or behavior of other people, especially in recent times. This is done in an ostentatious way, when values that are valuable for the followers of a given religion, mainly Catholic, are directly contested or ridiculed, or under the pretext of freedom of artistic expression. Therefore, it is extremely important to indicate the provisions on the basis of which it would be possible to protect religious feelings against such manifestations of overt or camouflaged contempt. In the context of civil law, this task was undertaken by the author of the reviewed book, rightly emphasizing that religious feelings, like any personal interest, are subject to civil law protection.

This article compares Jerzy Kalina’s installation The Poisoned Spring (2020) and Oliver Frljić’s performance The Curse (2017), analyzing how sculptures depicting John Paul II function in politically charged, mediatized performances. It maps layered modes of the papal image-object of worship, theatrical prop, commemorative monument, pastiche-and shows how their blurred status generates intense affect, public contestation, and legal disputes under Poland’s law on “offending religious feelings.”

Artykuł stanowi analizę porównawczą instalacji Zatrute źródło (2020) Jerzego Kaliny i spektaklu Klątwa (2017) Olivera Frljicia, wykorzystujących wizerunek Jana Pawła II.

The article indicates the norms of law established in the European Union and Poland developed on the basis of the teachings of the Catholic Church, emphasizing the dignity and freedom of religious feelings, the consumer as a human being. The issue has been compared with the controversial advertising campaigns that broadly use religious beliefs of consumers in order to increase their effectiveness. The stimulus to discuss this issue is the intensification of controversial advertisementsusing religious symbols and cults. This publication also points out the issue of offense of religious feelings in advertising and draws attention to the normative areas of their protection.

This paper presents a legal analysis of the crime stipulated in Art. 196 of the Criminal Code. Due to the limited framework of this study, the author confines her reflections to the analysis of the views of legal scholars and commentators on the subject matter and subject of protection and the material and personal side of the crime of offending religious feelings. Moreover, the author points to the lack of a statutory definition of the term “religious feelings,” demonstrating at the same time the legal consequences of such a state of affairs. The author postulates that Art. 196 of the Criminal Code be amended in terms of the concept analysed, pointing to the need to establish a legal definition of the term “religious feelings” or to exchange it with a concept defined so as to rule out freedom in interpretation of the scope of subject matter of protection under Art. 196 of the Criminal Code.

Przestępstwo obrazy uczuć religijnych – analiza prawna W artykule przedstawiono analizę prawną przestępstwa, o którym w art. 196 Kodeksu karnego. Ze względu na ograniczone ramy niniejszego opracowania Autor ogranicza swoje rozważania do analizy poglądów prawników i komentatorów dotyczących przedmiotu ochrony oraz materialnej i osobowej strony przestępstwa obrazy uczuć religijnych. Ponadto Autor wskazuje na brak ustawowej definicji pojęcia „uczucia religijne”, wykazując jednocześnie konsekwencje prawne takiego stanu rzeczy. Autor postuluje, aby art.

10 Konwencji o ochronie praw człowieka i podstawowych wolności. Dlatego ETPC powinien wyeliminować z uzasadnień swoich orzeczeń wszelkie braki argumentacyjne, luki i błędy merytoryczne.

In its judgement of 15 September 2022 in the case of Rabczewska v. Poland (App. No. 8257/13), the European Court of Human Rights (ECtHR) held that the conviction of a Polish singer for her statement made during a press interview – “It’s hard to believe in the writings of someone wasted from drinking wine and smoking some weed,” referring to the authors of the Bible – violated Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The findings and conclusions presented by the ECtHR in this case significantly differ from those given by the domestic courts. Despite the shortcomings identified in this study, the ECtHR’s judgement deserves approval. This underscores that adjudication by the domestic courts under Article 196 of the Criminal Code, which penalises insulting religious feelings, cannot be divorced from the Convention’s standards. Moreover, the ECtHR’s judgement in Rabczewska v. Poland requires that domestic courts engage in thorough reflection on the essence of insulting religious feelings in light of the ECtHR’s rulings. Accordingly, a clear standard for ECtHR adjudication in cases involving freedom of expression and the protection of religious feelings is highly desirable. Therefore, the ECtHR should eliminate all deficiencies in argumentation, gaps and substantive errors from its justifications of judgements.

Article 196 of the Polish penal code penalizes the offence of ‘religious feelings’. This may be seen as an attempt to protect religion without making it an official state matter, positing it as injuries to individual citizen’s psyche. This article investigates the negative consequences of framing art. 196 in terms of religious feelings, both in the doctrine, and for the theory of law and wider social functioning of legal provisions. I attempt to show how this regulation is faulty and does not satisfy the hopes which motivated passing it. The phrase ‘religious feelings’ results in many interpretative difficulties as well as conflicts which defy the conciliatory intent behind it. The article notes the broader impact of the regulation and attempts to situate this impact in the context of the theory of law. It looks into how the psychological dimension of the regulation brings confusion and defies knowledge about emotions. Finally, it analyzes the broad social consequences of the usage of this phrase in law, using the perspective of the law’s expressive function to diagnose its influence on society. The article’s central focus is on the categories that law uses and its implications both in strictly legal sphere and in public life. This allows for a new approach to the dangers of careless legal phrasing, as well as to the problems of using references to emotions in law. The texts offers tentative suggestions of reform of the law in question.

The article presents analysis of Rodrigo García’s Golgotha Picnic as an iconoclastic performance. The author refers to Slavic etymology of word obraza (injury) and shows that injuring as shaping is directly connected with artistic work and creating images. In the positive sense obraza implies a formation, in the negative sense — a deformation. In Garcíia’s performance act of injuring consists in deconstruction of Christ’s image. When an artist is doing his work he might offend directly only image of Christ not religious people. But this kind of deformation arouses profound opposition of Christians what is called offence of religious feelings. We should introduce a distinction between an offence of image as something objective and offence as subjective (emotional) reaction of individuals to this fact. People can feel provoke to accuse artist of offence of religious feeling even though it wasn’t his intention to offend them. However even if it wasn’t his intention to offend anyone his work might depreciate religion and change its importance in society. García used in his performance subversive strategies which can have a revolutionary potential.

The ECHR statement that the domestic courts did not assess whether the applicant’s statements had been capable of arousing legitimate indignation or whether they were of a nature to incite to hatred or otherwise disturb religious peace and tolerance in Poland is of key importance considering the judgment under review. ECHR rightly ruled that a religious group must tolerate the denial by others of their religious beliefs and even the propagation by others of doctrines hostile to their faith, as long as the statements in question do not incite to hatred or religious intolerance. In the absence of a legal definition, it is difficult to assess the social harmfulness of an act. The Court has recognised the issue that has existed for years in Polish criminal law – that the protection of religious feelings is ineffective and inadequate to the degree of the insulting nature of the criminal act. Poland violated Article 10 of the Convention, as the national courts failed to make a fair assessment of the social harmfulness of the act.

The article discusses the issues of the protection of the individual’s personal rights, pointing out their significance for the individual and society. Emphasis is laid on the necessity of protecting these values, along with relevant constitutional and civil law solutions, also in the norms of criminal law. The author presents the objective scope of the protection of the foregoing rights in Polish penal codes of 1932, 1969 and 1997, as well as the level of penal repression of behaviors violating these values. The scope of analysis covers the issues of the protection of human dignity and inviolability, freedom of conscience and religion, human life and health, as well as personal liberty in its different aspects. The author stresses that the protection of these personal rights is stable in Polish criminal law despite the changing political system conditions. Criminal law solutions strengthen constitutional and civil law protection. These values were and are protected in Polish penal codes to the extent equal to the European standards. The author critically assesses the proposals submitted to the Polish legislators, intended to confine the protection of human dignity to the level of civil law norms. He believes it was unjustified to introduce the aggravated forms of homicide into the penal code in force: they were not provided for in the Codes of 1932 and 1969. The author analyses the doubts concerning the grounds for inclusion of some new acts in the offences against freedom: recording of a picture of a nude person in a specific situation and persistent stalking.

Autor przedstawia przedmiotowy zakres ochrony wymienionych dóbr w polskich kodeksach karnych z 1932 r., 1969 r. i 1997 r. oraz poziom represji karnej zachowań naruszających te wartości. Analiza obejmuje problematykę ochrony godności i nietykalności człowieka, wolności sumienia i wyznania, życia i zdrowia człowieka oraz wolności osobistej w różnych jej aspektach. Rozwiązania prawnokarne wzmacniają ochronę cywilnoprawną i konstytucyjną. Wartości te były i są chronione w polskich kodeksach karnych w stopniu nieustępującym standardom europejskim. Autor krytycznie ocenia postulaty zgłaszane do polskiego ustawodawcy w kierunku ograniczenia ochrony godności człowieka do poziomu norm cywilnoprawnych. Analizuje wątpliwości dotyczące przesłanek wprowadzania do przestępstw przeciwko wolności niektórych nowych czynów – utrwalanie wizerunku nagiej osoby w określonej sytuacji oraz uporczywe nękanie.
