The author deals with the life and work of a Professor of Civil Law and Legal Philosophy at Charles University Emil Svoboda (1878-1948). Svoboda was extraordinary in his philosophical foundations, he related to Arthur Schopenhauer and to Masaryk’s humanism. He viewed the law from a sociological and psychological positions. He was convinced it was necessary to evaluate the law primarily ethically. Thus he found himself outside the legal dogmatics that dominated the legal discourse at that time. As a convinced democrat, Republican and supporter of freedom, he served the Czechoslovak Republic. He helped to establish a law school in Bratislava (1919), he was involved in preparing the curriculum of the Civil Code. After experiencing the crisis of democracy, the Nazi occupation of the Czech lands and the world war, he was tempted by the vision of a post-war ideas of better world. He died before the Communists in Czechoslovakia confused the fulfilment of the ideals of socialism for state terror, and did not get so disappointed in his hopes.
The article analyses the institute of laesio enormis and its nature in the Czech Civil Code. Based on a historic overview, the paper presents its development and philosophical background that can be found in the idea of the just price which has been considered an imperative of commutative justice. After the end of the Middle Ages, the concept of just price was heavily criticized for its alleged contradiction with contractual freedom and legal certainty. Nevertheless, the great civil law codifications in France and Austria encompassed laesio enormis. The regulation of laesio enormis in most modern civil codes (e.g. in Netherlands, Italy, or Switzerland), however, significantly resembles usury. The Czech Civil Code, which reintroduced laesio enormis to our legal system after more than sixty years, reflects the same trend. The prohibition of laesio enormis is conditioned by the fulfillment of a subjective feature: the injured party must not know the real price while the other party must know (or be required to know) a fact the disproportion is based on. Therefore, this regulation protects the party with less information rather than an abstract just price.

The paper, on the occasion of the 150th birth anniversary of Emanuel Tilsch (1866–1912), deals with his live, work and importance for Czech civil law jurisprudence. The bibliography of Tilsch is not rich, and yet he is one of the most influential authors of Czech-Austrian jurisprudence. Even today he is still referred to in literature and jurisprudence, and his views were apparently behind the recent recodification or contributed to the solution of some fundamental questions (e.g. autonomy of will and universal succession in the inheritance law).We chose to revisit the topics which are or could be still inspirational, that is the questions of principles, things in the legal sense and ownership of law, component and accessory of things, universal succession and inheritance, cohabiting persons, and acquisition of inheritance.

This article recalls the personality of the Civil Law scholar, Roman law scholar and politician Robert Mayr-Harting, who was born 150 years ago in 2024. An Austrian German, Mayr-Harting spent his childhood and youth in Vienna, where he also graduated from the Faculty of Law. His first university career took him to the provincial university in Czernowitz, but later he was called to the Faculty of Law of the German Charles-Ferdinand University in Prague, where he remained due to circumstances for many decades. From the beginning, he combined an interest in Roman law with an interest in modern Civil law, and later, after the First World War, this interest completely prevailed. The political change of 1918 brought about the removal of political ties of Germans in the Czech Lands to the headquarters of the political parties in Vienna, opened the way to the political path for some new faces, and among them was also Mayr-Harting, active in the German Christian Social Party, for which he was in the National Assembly in years 1920–1939. As a politician, he understood the disadvantage of the negativist policy towards Czechoslovakia and tried to promote a policy of activism. This culminated in the entry of German ministers into the government in 1926. Mayr-Harting fought the struggle for the activist direction of his own political party in the 1920s and again in the 1930s. Despite his political activity, the scholar left a professional work of considerable importance, consisting of Civil law and Roman law monographs and articles, and also of the comprehensive textbook of Civil law.

Ta vyvrcholila vstupem německých ministrů do vlády roku 1926. Boj o aktivistické směřování své vlastní politické strany sváděl Mayr-Harting ve 20. letech a znovu i v letech 30. Navzdory politickému působení zůstalo za učencem odborné dílo nezanedbatelného významu, sestávající z civilněprávních a římskoprávních monografií a článků a zahrnující i soustavnou učebnici občanského práva a poznámková vydání zákonů.
Partial invalidity of legal acts is in the Czech law set in Section 576 Civil Code. This provision stipulates specific conditions under which this procedure is applicable, more precisely under which conditions a legal act is invalid in its entirety, instead of partially. However, full invalidation often significantly impacts legal certainty and reasonable expectations of the parties. Therefore this construct is to be applied with maximum caution and only in the uttermost cases in which the application of only partial invalidity due to different reasons is not possible. This contribution has the ambition to clarify the fundamental principles of the concept of partial invalidity and to compare it with the past legislation, as well as with selected foreign laws. The aim of this contribution is also to focus on problematic application of this procedure stemming from theoretical considerations and using practical examples. Problems with this phenomenon relate especially to the practice of the Supreme Court of the Czech Republic, which is not judicially consistent in this area. The author has the ambitions to explain why the Czech law as well as foreign laws and international legal environment increasingly lean towards partial invalidity.
