The article concentrates on issues of the State Tribunal in contemporary political order of the Republic of Poland. In the beginning there was explained the place of the State Tribunal in the system of separated powers. Next, applying the legal-historical method there was reconstructed its model in Polish political regulations, starting from the Constitution on 17 March 1921. Hereinafter there was made analysis of the contemporary position and competence of that State Tribunal and who can be the subject to his cognition. There was distinguished a constitutional and disciplinary responsibility, clarifying the being and premises for each of them. On the basis of made arrangements there was taken an attempt of evaluation of the contemporary constitutional regulation, formulating appropriate conclusions de lege ferenda.

Artykuł koncentruje się na problematyce Trybunału Stanu we współczesnym porządku ustrojowym Rzeczypospolitej Polskiej. Na wstępie określono miejsce Trybunału Stanu w systemie podzielonych władz. Następnie dokonano rekonstrukcji tej instytucji w kolejnych polskich regulacjach ustrojowych, począwszy od Konstytucji z dnia 17 marca 1921 r. W dalszej części przedstawiono współczesną pozycję i kompetencje Trybunału Stanu, wskazując krąg podmiotów podległych jego kognicji. Wnikliwej analizie poddano zagadnienie odpowiedzialności konstytucyjnej oraz odpowiedzialności karnej, wyjaśniając istotę i przesłanki każdej z nich. Na podstawie dokonanych ustaleń podjęto próbę oceny współczesnej regulacji prawnoustrojowej, formułując stosowne wnioski de lege ferenda
In this paper, we presented the criminal responsibility of the Republic of Poland President before the Tribunal of State and related issues. Objective scope of this responsibility against other republican European countries was described. Time scope of the criminal responsibility of the president as well as matters related to the procedure and modes of impeachment by the National Assembly have also been mentioned. In the second part of the paper, we presented the right to fair trial issues and characterized the role of the Tribunal of State as the adjudicating body in the criminal proceeding. International Criminal Court judicature was also mentioned.

The article presents the justification for the removal of the normative content of the provisions of Article 22 § 1 and 2. This justification is based on the observation that the solution underlying these provisions limits the scope of criminal liability for instigating and aiding a circumstance unrelated to the behavior of the instigator and helper, thus not allowing for an assessment in this respect in fully adequate to a specific case of criminal incitement and aiding and abetting.

Uzasadnienie to opiera się na spostrzeżeniu, że rozwiązanie leżące u podstaw tych przepisów odgórnie limituje rozmiar odpowiedzialności karnej za podżeganie i pomocnictwo okolicznością niemającą związku z zachowaniami podżegacza i pomocnika, co nie pozwala na dokonanie w tym zakresie w pełni adekwatnej oceny zarówno konkretnego przypadku przestępnego podżegania, jak i konkretnego przypadku przestępnego pomocnictwa.
In the study, the proceedings in petty offences have been described in terms of the tasks imposed by law on work inspectors. Liability for an offence is a criminal liability sensu largo, and the proceedings in petty offence cases are similar to criminal proceedings. In cases provided for in the act, a work inspector conducts explanatory investigation in the course of which he may impose a fine on the offender, be satisfied with applying educational measures only or decide to file a motion for punishment in the court. In the latter case, after instituting the proceedings by the court, the work inspector acts as a public prosecutor. Issuing a sentence punishing for an offence, the court, as a rule, specifies the character of legal relationship between the employer and the wronged person.
Problematyka odpowiedzialności karnej lekarzy za nieudzielenie pomocy osobie jej potrzebującej jest opisywana w zakresie poszukiwania źródła tej odpowiedzialności. Autorka konstatuje, że udzielenie pomocy jest obowiązkiem, a nie przywilejem lekarza. Stanowisko to potwierdzają przepisy Kodeksu karnego.

The author concludes that providing medical aid is an obligation, and not a doctor’s privilege. This standpoint is confirmed by the provisions of the Criminal Code.

The Volhynia Massacre was one of the most inhumane crimes committed in the twentieth century, during the Second World War, and directed against civilians – against Poles. The time frame of Volhynia Massacre was 1943-1945. The perpetrators of the massacre were the Organization of Ukrainian Nationalists (OUN) and its military wing, called the Ukrainian Insurgent Army (UPA). Article 118 § 1 of the Polish Penal Code of 1997 introduced the notion of genocide into Polish domestic law. The Volhynian massacres have all the traits of genocide listed in the 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide.

This publication is devoted to the issue of combating “legal highs” by means of criminal law. In connection with the prepared amendments to the regulations, it is necessary to subject the proposed changes to an analysis. Essentially, one should agree with the need to introduce criminal liability for the possession and marketing of “legal highs”, although it seems that the presented projects do not solve all the problems already diagnosed.
Przedmiotem niniejszego opracowania jest przybliżenie zasad odpowiedzialności członków zarządu spółek kapitałowych. Autorka prezentuje podstawowe cele i zasady organu wykonawczego, tj. zarządu, i związane z tym obowiązki spoczywające na jego członkach. Naruszenie nałożonych na nich obowiązków może prowadzić nie tylko do odpowiedzialności cywilnoprawnej, lecz także do odpowiedzialności karnej. The author presents the basic objectives and principles of management and related obligations on its members. Violation of obligations imposed on them can lead not only to civil liability but also criminal liability. The present study is to analyze the constituent elements of art. 296 of the Criminal Code in the context of liability of the members of the supervisory board. For this purpose, the author attempts to synthetic approximation of the current achievements of the doctrine and jurisprudence, to define the mark, “dealing with financial affairs or business”. Analysis of the collected material reveals some discrepancies in the theory and practice. Finally, the author draws conclusions de lege ferenda aimed at developing a uniform interpretation of the concept of the mark “deals with financial affairs or business” including also supervision.
Obowiązujący Kodeks karny Ukrainy pokazał, że potrafi skutecznie odpowiedzieć na wyzwania związane z wojną rozpętaną przez Federację Rosyjską przeciwko Ukrainie. Rozdział XX części specjalnej Kodeksu karnego Ukrainy zawiera szereg artykułów kwalifikujących przestępcze działania rosyjskich okupantów. Przede wszystkim jest to artykuł 438 „Naruszenie praw i zwyczajów wojennych”. W swojej treści w dużej mierze odzwierciedla zgodność ukraińskiego krajowego prawa karnego z przepisami prawa międzynarodowego w zakresie regulacji odpowiedzialności za popełnienie karalnych naruszeń międzynarodowego prawa humanitarnego (prawa konfliktów zbrojnych). Dokonano porównawczej analizy prawnej ustawodawstwa ukraińskiego i polskiego pod kątem odpowiedzialności karnej za naruszenie praw i zwyczajów wojennych. Karalne naruszenia międzynarodowego prawa humanitarnego podlegają karze z art. 122–126 Kodeksu karnego Rzeczypospolitej Polskiej. Szczegółowa analiza treści tych artykułów Kodeksu karnego RP wykazała istotną różnicę pomiędzy normami polskiego prawa karnego w zakresie uszczegółowienia czynów, które polski ustawodawca określił jako naruszenie międzynarodowego prawa humanitarnego. W szczególności, jak widzimy, poza ogólną koncepcją ludności cywilnej, polskie prawo karne jako ofiary proponuje osoby, które składając broń lub nie mając środków ochrony, poddały się, ranni, chorzy, rozbitkowie, personel medyczny, duchownych, ujednolicając koncepcję wszystkich osób korzystających z ochrony międzynarodowej podczas działań zbrojnych. Takie stanowisko polskiego ustawodawcy jest bardziej konstruktywne i ściślej powiązane z właściwymi międzynarodowymi aktami prawnymi niż odpowiadająca im norma Kodeksu karnego Ukrainy. Ponadto § 2 art. 123 Kodeksu karnego RP zapewnia rozszerzone rozumienie złego traktowania ofiar, którego nie ma w art. 438 Kodeksu karnego Ukrainy. Ustawodawca ukraiński zignorował także naruszenia międzynarodowego prawa humanitarnego, na które wskazuje art. 124 Kodeksu karnego RP – co także działa na korzyść polskiego prawa karnego, starając się przestrzegać przepisów prawa międzynarodowego w większym stopniu prawo humanitarne.

The current Criminal Code of Ukraine has shown that it can effectively respond to the challenges associated with the war unleashed by the Russian Federation against Ukraine. Chapter XX of the Special Part of the Criminal Code of Ukraine contains a number of articles that qualify the criminal acts of Russian occupiers. First of all, this is Article 438 “Violation of the laws and customs of war”. In its content, it largely reflects the compliance of Ukrainian national criminal law with the provisions of international law in the field of the regulation of responsibility for committing criminal violations of international humanitarian law (the law of armed conflicts). A comparative legal analysis of Ukrainian and Polish legislation was carried out in terms of criminal liability for the violation of the laws and customs of war. Criminal violations of international humanitarian law are punishable under Articles 122–126 of the Criminal Code of the Republic of Poland. A detailed analysis of the content of these articles of the Criminal Code of the Republic of Poland showed a significant difference between the norms of the Polish criminal law in terms of detailing the acts that the Polish legislator defined as a violation of international humanitarian law. In particular, in addition to the general concept of the civilian population, the Polish criminal law proposes as victims persons laying down their arms or having no means of protection, the surrendered, the wounded, the sick, the shipwrecked, medical personnel, the clergy, unifying the concept of all persons enjoying international protection during armed hostilities. This position of the Polish legislator is more constructive and more closely connected with the relevant international legal acts than the corresponding norm of the Criminal Code of Ukraine. In addition, § 2 of Article 123 of the Criminal Code of the Republic of Poland provides an expanded understanding of ill-treatment of victims, which is not found in Article 438 of the Criminal Code of Ukraine. Also, the Ukrainian legislator ignored those violations of international humanitarian law which are indicated in Article 124 of the Criminal Code of the Republic of Poland – which also works in favour of the Polish criminal law, as it tries to comply with the provisions of international humanitarian law to a greater extent.
Environmental protection is an area of interdisciplinary, in which the rule is the use of concepts relevant to the legal sciences, natural sciences, engineering, or chemical. Therefore, in practice, they may mean different things depending on the conceptual context in which they are used. The concept, which draws attention to the rights and duties of citizens, public authorities, or environmental organizations, is a responsibility in protecting the environment. The state authorities should support citizens in their efforts to protect and improve the environment. Ecological safety, which is to be provided by a public authority is a state of the environment that allows you to safely stay in it and use it. The instrument to ensure that safety is the protection of the environment, which acts as a directive interpretation when there are doubts as to the scope of duties, such duties, and how they are implemented.
Summary The article discusses the fraudulent award of EU grants as a white collar crime. Poland joined the European Union in May 2004, opening up the door for new criminal groups to commit financial offences against the interest of the EU. This paper presents a critical analysis of the Polish provisions on EU grants. The first major problem he discusses is the legal qualification of the offence under Polish law. An offender may be charged under several articles of the Polish Criminal Code (286 § 1, 297 § 1, or 82 § 1 of the Fiscal Criminal Code.) The author explains the differences and similarities between these provisions. he concludes that the current provisions require amendment, in particular he argues that Article 297 § 1 of the Polish Criminal Code should not be used as an instrument for financial protection against EU fraud.

Streszczenie Artykuł podejmuje problematykę wyłudzenia dotacji z Unii Europejskiej jako istotnego rodzaju działalności tzw. „białych kołnierzyków”. Akcesja Polski do Unii Europejskiej, która miała miejsce w maju 2004 roku, spowodowała, że grupy przestępcze zyskały nowy obszar dla swojej działalności w postaci możliwości wyłudzania dotacji na szkodę interesów finansowych tej organizacji. Artykuł stanowi krytyczną analizę obecnych uregulowań dotyczących bezprawnego uzyskania wsparcia finansowego z UE. Głównym problem jest kwestia kwalifikacji prawnej czynu polegającego na wyłudzeniu dotacji. Stwierdzić należy, że do omawianej problematyki nawiązuje art. 286 § 1 k.k., art. 297 § 1 k.k. oraz art. 82 § 1 k.k.s. Autor wyjaśnił różnice oraz podobieństwa zachodzące między tymi przepisami. Analiza treści tych przepisów doprowadziła do wniosku, że obecna stylizacja norm Kodeksu karnego wymaga zmiany. W ocenie autora, dotacja powinna zostać wyłączona z katalogu instrumentów finansowych chronionych w art. 297 § 1 k.k.
The article is devoted to the topical problem of illegal acts (offences) against religious structures and temples and criminal liability for such acts under the criminal law of Ukraine. Special attention is paid to the legal principles and features of the concepts of the subject and object of such illegal acts. The characteristic features of subjective criteria of unlawful acts perpetrated against religious structures and temples are highlighted and described. Having analysed the aforesaid criteria of such offences under Articles 178 and 179 of the Criminal Code of Ukraine, the author casts more light on some of such offences. The article is of interdisciplinary nature at the interface of criminal law and denominational law.

In this case, the court expressed its support for the introduction of the statement under penalty of perjury by the Municipal Council in the tax return without legal grounds for such a clause. According to the commentator, the analysed judgment contains no logical justification and the introduction of a statement of this content is contrary to the principle of the rule of law implemented in the procedure of tax. As a result of the research it was assumed that penal-fiscal re-sponsibility comes under the law in relation to certain documents and the introduction of a statement as groundless does not constitute “awkwardness” body but a deliberate action aimed at obtaining relevant information from the taxpayer that would not be willing to submit it if not penalty of perjury or penal-fiscal responsibility.

W omawianej sprawie sąd wypowiedział się pozytywnie o możliwości wprowadzenia przez Radę Gminy w deklaracji podatkowej oświadczenia pod rygorem odpowiedzialności karnej, bez podstawy prawnej takiej klauzuli. W ocenie glosatora analizowane orzeczenie nie zawiera logicznego uzasadnienia, a wprowadzenie oświadczenia tej treści stoi w sprzeczności z zasadą praworządności realizowanej w ramach procedury podatkowej. W wyniku przeprowadzonych badań przyjęto, że odpowiedzialność karnoskarbowa wynika z mocy prawa w stosunku do niektórych dokumentów, a wprowadzenie oświadczenia w sposób niezasadny nie stanowi „niezręczności” organu, lecz celowe działanie skutkujące pozyskaniem odpowiednich informacji od podatników, których nie podaliby bez rygoru odpowiedzialności karnej lub karnoskarbowej.
This study presents the issue of alcohol consumption and its possible effect(s) on an offender’s ability to comprehend the significance of his/her actions or to control his/her behaviour. The legislative provision that allows to justify the full responsibility of the offender being in a state of inebriation in the same unit of a legal text like insanity and significantly restricted sanity (Article 31 of Polish Penal Code) indicates that there is a connection between these states. From a psychopathological standpoint, they are obviously connected by the disrupted functioning of the perpetrator’s mental activities. These disturbances, when the offender is under the influence of alcohol, need not result into his full responsibility and, in some, giving to characterize and statistically present cases, can lead to a reduction or even abolition of the soundness of the perpetrator of the offense. These problems were the stimulus to undertake research work, the results of which are also presented in this paper.
Public presentation of colour photographs depicting bloody, dead human fetuses on the streets, squares, parking lots or in front of cemetery as part of the so-called pro-life defenders is an offense under Article 140 of the Polish Code of Petty Offences. Also Article 51 of the Code of Petty Offences rules that Polish social standards of public behavior disallow all actions that may provoke outrage with at least one individual, which includes imposing on other, random people photos of bloody human bodies. Thus, such conduct violates public decency protected by both legal provisions named above. This standard of moralitydoes not apply to behaviors relating to the sexual or sexual sphere alone, but also to any behavior visible to other people who may cause outrage, opposition, anger or condemnation.

Publiczne prezentowanie barwnych zdjęć zakrwawionych, martwych ludzkich płodów na ulicach, placach, parkingach czy przed cmentarzem w ramach aktywności działaczy pro-life stanowi wykroczenie z art. 140 k.w., w przypadku zakłócenia porządku lub spokoju publicznego bądź wywołania zgorszenia u choćby jednej osoby – z art. 51 k.w. W Polsce normy publicznego zachowania nie dopuszczają narzucania innym, przypadkowym osobom, zdjęć zakrwawionych zwłok ludzkich. Zatem zachowanie takie narusza obyczajność publiczną chronioną przez oba przepisy. Obyczajność ta nie dotyczy bowiem tylko zachowań odnoszących się do sfery seksualnej czy płciowej, lecz jakichkolwiek zachowań dostrzegalnych dla innych osób, które mogą wywołać zgorszenie, sprzeciw, gniew czy potępienie.
