The Rule of Law is currently the dominant concept both on the level of individual states (that is, the democratic states) and on the level of the international community. Considering the differences of international law and domestic law the concept of the Rule of Law cannot be identical in both. In the main features, particularly in the obligation of states to adhere to the norms of the international law in relation to individuals, the concept of the Rule of Law is, at least formally, fulfilled. In comparison to domestic law, the observance of the norms of the international law in the real world, is much more problematic. There is no universally recognized and accepted executive power which would act under court control. The states on the one hand proclaim observance of the international law, on the other they too often do not observe it in praxis and interpret the norms of the international law to suit their purposes. The Rule of Law is particularly reflected in the international protection of human rights. The influence of the international law is evident particularly in regional regulations of human rights. On the other hand, the Rule of Law is problematic in the area of the prohibition of the use of armed forces. The importance of the Rule of Law is stressed as one of the key elements in the area of peace missions, prevention of conflicts, peace keeping, etc. The Rule of Law in the system of international law is present in other areas that, however, are not dealt with in this paper.

Reservations to human rights treaties have been the focus of theory and practice for many years. By clarifying number of issues The Guide to Practice of the International Law Commission (2011) made a significant progress in these discussions. This article discusses some particular aspects of this theme, such as admissibility of reservations to international human rights treaties and consequences of invalid reservations. It analyses the practice of the Czech Republic in making reservations and objections to reservations to international human rights treaties. The Czech Republic performs rather well with respect to reservations. Concerning objections to reservations, the progressive trend of supra-maximum effect of objection should be appreciated. On the other hand, a reference to the national law should be argued more precisely and this article suggests some recommendations in this respect.

Výhrady k mezinárodním smlouvám o lidských právech patří k dlouhodobě diskutovaným tématům nauky i praxe.

The paper examines the concept of solidarity as discussed in contemporary political philosophy. It is a concept that has remarkable constitutional-legal relevance, but it has received much less attention than other concepts. In the literature, solidarity is understood as a polysemantic concept and typically three forms of solidarity are distinguished: social, civic and political solidarity. In this paper, I will introduce these three forms of solidarity and then look more closely at civic solidarity. The latter is associated with the concept of the welfare state and draws our attention to the specificities of relations that already emerge in the political community and can produce arrangements that could be described as unjust. And it is precisely the motif of injustice, in its specific form of structural injustice as Iris Marion Young has thought of it, that guides my discussion of civic solidarity and its relevance for constitutional and human rights theory and practice, because it points to specific background phenomena to which we should not be indifferent.

Martin Hapla’s new book is a systematic monograph on the relationship between utilitarianism and human rights. The author declares that the focus of this work is a justificatory project. That is, human rights are morally right because they are utilitarian good. In my response, I will try to show that the crux of Hapla’s work actually lies in a different project, which is more explanatory in nature. I will formulate an ele-mentary reconstruction of that project by means of three theses: 1) The straw man thesis: The criticism that utilitarian conclusions contradict moral intuitions, or human rights, is based on the false premise that utilitarianism ignores morally relevant facts, especially about human nature. 2) The translation thesis: The criticism that utilitarianism ignores morally significant values overlooks the point that utilitarianism reflects these values in terms of empirical facts. 3) The empirical explanation thesis: Utilitarianism seeks to minimize normative or value ideology and maximize working with empirical facts. This analysis of the facts, when done correctly, can ultimately explain why we prefer a particular ideology.

The article focuses on the applicability of human rights instruments in the protection against negative impacts of climate change. It follows from the findings that have been confirmed by international human rights bodies on human rights commitments of states in the field of environmental protection. The author identifies the main difficulties that arise for the application of human rights instruments from the specific characteristics of climate change, especially from a global spread of anthropogenic greenhouse gas emissions by a great number of state and non-state actors and their cumulative effects with emissions from natural sources, and from an unequal geographical distribution and diversity of its impacts. The text then concentrates in more detail on two selected issues of interlinking human rights and climate change: on the time lapse between the causes and consequences of climate change that leads to the need to take into account the interests of future generations within the concept of human rights, and on the extraterritorial character of impacts of greenhouse gas emissions that leads to considering that we need to surmount the current limitation of human rights obligations within the state territory resp. the state jurisdiction. In both issues, the current state of affairs in the theoretical elaboration and judicial interpretation are examined, especially with an eye for future solutions.

In spite of a long-lasting criticism by several international human rights bodies, the Czech Republic is the last EU member state which still perform therapeutic surgical castration of sex offenders and men suffering from certain paraphilias. While critics consider the practice medically unnecessary and inhuman, proponents claim that therapeutic surgical castration offers the last hope to patients in whom other treatment options failed. This paper analyses the question of whether and under what circumstances can surgical castration be considered permissible. After that, the legal regulation in the Czech Republic and the relevant international criticism are dealt with. The identified criteria of permissibility are then applied to the Czech regulation and practice of castration.

The article is a contribution to the ongoing debate on human rights and their possible extention to animals. If we accept the existence of natural rights, we should be also able to justify why they belong only to human beings. However, trying to define the criterion seems problematic. The argument from marginal cases shows that the characteristics possessed only by human beings are not possessed by all human beings, and characteristics possessed by all human beings are not possessed only by human beings. However, if we try to dismiss the problem by implying as a standard criterion on humanity as such, then there is a problem involving evolutionary theory. It tells us that the evolution of modern man was not only gradual, but there were also several different human species coexisting. The fundamental problem of human rights is the necessity to draw the line not only at present but also for past times if we want to secure their universality. It is possible to expand the concept of natural rights to animals, but we would have to deal with the same problem of justification. That is because there is no disagreement in the field of empirical facts, but a disagreement in morals where no cognizable truths exist.

Spory o rozsahu a obsahu přirozených práv totiž nejsou neshodou v oblasti empirických faktů, nýbrž neshodou v morálce, kde žádné zjistitelné pravdy neexistují.

Kritický nástin politizace soudní moci

The paper deals with judicialization of politics. In constitutional democracies, the political system is limited by the legal framework, which is usually enforceable before court. The courts, therefore, by definition, to a certain extent co-decide on the form and content of policy. The current radicalization of society is, in my opinion, largely caused by the depoliticization of the public affairs. The role of judges on the other hand cannot be overstated. Here I present a critical perspectives on the role of judges in the political process. My aspiration is not to present an absolutely objective account of the issue, but to present and defend critical arguments intended to be an incentive to launch a debate on the outlined issues. I present this process as a risk to the current political system, which limits politics and the public in their ability to decide on important societal issues and subsequently to accept responsibility for these decisions. My article should not be seen primarily as a critique of judicial power; but as a warning against the weakness of the political environment, which results in the politicization of the judiciary, which brings substantial risk nationwide.

Má práce se věnuje politizaci moci soudní.V ústavních demokraciích bývá politický systém ohraničen právním rámcem, který je zpravidla vymahatelný před soudem. Soudy proto z povahy věci v určité míře spolurozhodují o podobě a obsahu politiky.

The concept of decent minimum of health care is broadly discussed in foreign countries. In the Czech Republic, nevertheless, the concept of decent minimum of health care is practically unknown. Although there is general agreement that health, in its definition of complete physical, mental and social well-being, is fundamental to a dignified human life, the extent of health care that meets the criterion of a decent minimum of health care necessary to ensure a dignified human life is the subject of professional debate. This article critically evaluates the arguments for the implementation of the concept of a decent minimum of health care into current legislation of the Czech Republic.

The German Parliament shall adopt new legislation concerning intersex persons by the end of 2018. The law should introduce a third, positive category of gender, in addition to „male” and „female” categories or repeal state registration of gender altogether. This follows from a landmark ruling by the German Constitutional Court of 10 October 2017 in case of Vanja, in which the court said that an intersex person, who is neither male nor female, is entitled to register their gender as such. The article summarizes complex developments that led to the ruling and discusses options of its implementation.

Německý zákonodárce má přijmout do konce roku 2018 novou právní úpravu týkající se intersexuálních osob. Zákon by měl zavést třetí, pozitivní kategorii pohlaví vedle pohlaví mužského a ženského anebo zrušit evidenci pohlaví osob prováděnou státem.

According to Martin Hapla, human rights should be conceived as justified moral rights. We have human rights in this sense because there are compelling reasons for them, namely, that in the long-term and universal perspective, their observance leads to the maximization of utility, even though there may occasionally be stronger reasons in the long-term and universal perspective for their violation. Docent Hapla calls this the utilitarian justification of human rights. Hapla’s argument must face at least four objections. The justification of moral rules leading to the maximization of utility in the long-term and universal perspective does not necessarily establish the justification of moral rights, and if it does, not automatically universal human rights. Furthermore, utilitarian justification, whether of rules or human rights, would likely have to rely on paternalistic foundations, which utilitarians would probably reject. Finally, in my opinion, we must ask Professor Hapla a provocative question: whether his consequentialism does not parasitize on deontological thinking.
CS
Docent Hapla to nazývá utilitaristickou justifikací lidských práv. Haplova argumentace musí čelit nejméně čtyřem námitkám. Justifikace morálních pravidel vedoucích v dlouhodobé a univerzální perspektivě k maximalizaci užitku ještě nezakládá justifikaci morálních práv, a pokud ano, nikoliv automaticky univerzálních lidských práv.

The article deals with the effectiveness of incorporating human rights into legal systems. It responds to Eric A. Posner, who, from short-term observation, questions the effectiveness of the outcomes of human rights treaties. At first, the text focuses on the need to change primarily social norms, as these represent stronger motivation for human behaviour than the law. The text further emphasizes the need for internalization since social norms must comply with personal normative beliefs to maximize their effectiveness. It states that if we want to support the creation of social norms or creation or change by adopting a legal norm, it must be moderate, not in significant conflict with existing social norms. Overall, it is a long-term process. The article argues that the adoption of human rights treaties cannot immediately transform into social norms, let alone make the individual members of society internalize them to be truly effective. It claims that even if human rights treaties’ effectiveness could be empirically examined, it could not be concluded shortly after their adoption. Finally, the text points out the fundamental problems of empirical research in human rights that we should consider if we would like to build further arguments on its results.

The article highlights differences in the conception of human and fundamental rights, focusing on the effect of fundamental rights on legal relations of legal or juristic persons as artificial legal entities. Human rights belong exclusively to people, while fundamental rights can also be granted to legal persons by the constitution maker. Given the different nature of legal persons versus people, a more detailed theoretical justification of the applicability of fundamental rights to legal entities is needed. The factual inequality in the nature and, often, in the economic power of natural and legal persons, also leads to a different view of the horizontal effects of fundamental rights in relations between a natural and a legal person than in legal relations between two natural persons.

a1_The issue of religious symbols in the public space has given rise to widespread debate on the scope of freedom of religion and of the State’s neutrality in various countries around the world. Over the years, it has become a source of vigorous legal and political controversy. In Europe in particular, this question chiefly concerns the wearing of headscarves. Bans (often formulated as either bans on headgear or as general bans on religious symbols or dress) have been introduced by many countries and in many areas of life. Islamic dress tends to be commonly perceived (at least in the west) as being associated with the subordination of young girls and women and the perceived link with what is commonly termed "Islamic fundamentalism". The wearing of religious symbols has been discussed both from a socio-political as well as legal perspective. These developments, particularly attempts to change a cultural reticence to publicly express faith into a legal obligation to refrain from religious expression in certain circumstances, have brought major challenges for European human rights law, most notably in relation to the wearing of religious dress. Although most European legal systems provide protection for religious freedom and to religious minorities, the scope of this protection is affected by many factors, such as history, (constitutional) traditions and social factors. In essence, the term European human rights culture developed in the interplay of jurisprudence between The Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR). The text explores the two recent CJEU rulings and juxtaposes it against the recent developments in the ECtHR jurisprudence, focusing on how CJEU departs from the established manner set out by the ECtHR of dealing with cases involving the limitations on fundamental rights. The purpose of this is to present a reflection of the recent state of the European human rights culture, which has, in the past years, become very dynamic.

Lidská práva v kontextu kulturní evoluce:

Main aim of this paper is to present naturalistic theory of human rights, which shows that despite the fact that human rights can be seen as basic moral requirements they are society-dependent, which means they are connected to the society and its evolution. First part of this paper deals with the starting-point of this approach – what this naturalization means. I want to point out that it really does not mean that all the things and all issues can be reduced to physical or chemical properties and laws. The fact that we – human beings – have language also makes us discursive beings and we can build fantastic worlds to live in – as Peregrin points out. We do not have to live in the natural world as such, in the realm of nature where natural laws, e.g. physical, chemical, etc. are the only thing that matters, our world that we live in and which we build is also normative – realm of freedom – where there exist other rules which matters – and our freedom lies in the fact that we can obey but also disobey them. This is our ability which makes us different among other organisms and because of this our ability Darwinian evolution is not the only evolutionary process that plays the crucial role in our evolution, according to some philosophers and cognitive scientists there is also a process which they named cultural evolution. So, next part will be devoted to the concept of cultural evolution which might not be interesting just for cognitive scientists and philosophers but also for scientists who work in the field of social science, law and jurisprudence. This is caused by the fact that this theory works with rules and their place and function in society. In this part we will focus on the evolution of morality because as we will see human rights can be seen as basic moral requirements which are necessary for global cooperation.

Strategic litigation is a form of legal action that aims to achieve change beyond the individual interests of the claimant. It is most often employed by individuals or groups who lack sufficient influence within the political process to effect change through standard legislative means. Ideally, strategic litigation will influence legal interpretation, challenge existing norms, or spark broader societal debate through court decisions at the level of constitutional or other high courts. Although it originated primarily in the Anglo- American legal system, strategic litigation is becoming increasingly prevalent in Europe, including in continental legal systems such as that of the Czech Republic. In Europe, strategic litigation is becoming more prominent, particularly in areas where there is a lack of political will to address socially complex or controversial issues. Typical topics include minority rights, equal access, climate justice, and reproductive rights. Despite its growing practical relevance, the phenomenon remains under-explored academically, especially at the national level. While it is difficult to define precisely or identify reliably in individual cases, an increasing number of stakeholders, ranging from NGOs to legal professionals, are employing strategic litigation as both a legal tool and a means of political and societal mobilisation.

The age of rights has been replaced by the age of proportionality. Human dignity is the highest absolute value from which other fundamental rights are derived. The absolute theory of human dignity is based on Kant’s concept of dignity of rational beings. But what if Kant’s concept of dignity is more about duties than rights? How does Kantian deontology combine with the proportionality of relativizing fundamental rights? The article analyses Kant’s conception of duty in the Doctrine of Right in the context of the concept of dignity in the Groundwork for the Metaphysics of Morals and in the Doctrine of Virtues, and it follows the development of a different philosophical interpretation in the contemporary discussion on human rights.

Článek analyzuje Kantovo pojetí povinnosti v Právní nauce v kontextu pojmu důstojnosti v Základech metafyziky mravů a v Nauce o ctnostech a sleduje vývoj odlišné filozofické intepretace v současné lidskoprávní diskusi.

Přímluva za teorii legitimních cílů

EN
When we talk about the limitation of rights, we traditionally proceed from identification of fundamental rights to identification of reasons permissible for their limitation (public order, national security, public morality etc.). That implies conceptual priority of fundamental rights and lower focus on the definition of legitimate aims as set out by the Charter of Fundamental Rights and Freedoms in the so-called limitation clauses. It is precisely identification of legitimate aims that is the singular purpose of the second step of the test of constitutional conformity in the case-law of the Czech Constitutional Court. While the Court’s decisions are abundant in definitions of contents, scopes, natures and functions of fundamental rights, legitimate aims fell short of receiving such attention. Does it mean that for the Constitutional Court this category does not raise any questions?

The paper strives to answer a seemingly apparent question about permitted and forbidden behavior in law. The aim is to show that the answer is complicated not only due to the fact, that law is a very complex system of legal rules. The true nature rests in fact, that rules comprised in law are quite often deliberately challenged by their recipients. The paper strives to show the cause and present examples. Inter alia, there is tension between the concept of democracy and concept of human rights present in the background.
