This discussion study addresses the ontological and ethical questions that can be found in Myšlení a tvorba Egona Bondyho (The Thought and Creative Work of Egon Bondy), edited by Petr Kužel. This is the first monograph dedicated to the work of this original thinker. In the introductory part, I deal with the reasons that led to Bondy’s work being neglected up to this point in time by those who interpret philosophy. In the second part, I summarize the axiological and logical arguments put forward by the authors of the section of the book concerned with ontology, which should show that Bondy’s abandonment of the category of substance was justified. Then I explore two possible objections to the axiological justification of a non-substantial ontology and an objection to its logical justification. Nonetheless, in all parts of the study I show that Bondy anticipated a number of the principal themes of contemporary ontology and the theory of artificial intelligence, which have figured, for example, in the work of Slavoj Žižek or Nick Bostrom. In the closing part, I formulate some topics that, I believe, further research on Bondy should focus on.

EN
This study deals with the issues surrounding literature generated by artificial intelligence or artificial neuron networks. The authors first critically analyse the results of these generative projects, including Czech and Slovak ones, comparing poetry and prose text generating projects. The fact that many of the texts generated in this way are practically indistinguishable from those written by humans is understood as a challenge to reassess existing theoretical approaches to the process of generating a literary text and the overall modelling of the literary system. In these contexts the literary system appears to be an autonomous structure that does not need any external input to produce texts, but makes do with its own text material and its transformational recombination.

Umělá inteligence jako nositelka základních práv?

EN
This paper deals with the issue, whether artificial intelligence should have any fundamental rights and whether such an idea is legitimate. The first prerequisite necessary for granting any fundamental rights to artificial intelligence is its legal personality. Should the current scale of legal subjects be supplemented with a new category – so called electronic person? Should law – bearing in mind that artificial intelligence is not merely capable of autonomous actions, but also has its own interests and is able to recognize the consequences of its actions – award (constitutional) protection equal to the protection provided to other legal subjects?

Měla by v době, kdy umělá inteligence (GAI) bude při jednání sledovat své vlastní zájmy a bude schopna rozpoznat následky svého jednání, vzniknout další osobnostní kategorie – tzv. status elektronické osoby? Mělo by právo takové GAI garantovat (ústavní) ochranu rovnou ostatním subjektům?

In 2023, we saw the rise of artificial intelligence (AI) and its expansion to mass use by users around the world. However, AI also brings significant privacy challenges, as do all previous significant changes in modern technology. Globally, two approaches to AI in the context of data protection can be observed, one approach represented mainly by the United States of America and the other approach represented mainly by the European Union. The US focuses mainly on innovation and flexibility, while the EU emphasises privacy and security over technological advancement. The present paper will focus on the protection of users when using AI and the specific privacy risks of AI, including unauthorised access to sensitive data, misuse of data for tracking and profiling users, and lack of transparency of algorithms. In relation to the risks of using AI, the paper will focus on the EU’s proposed regulation setting out harmonised rules for AI, the so-called AI Act. This would provide a comprehensive framework for AI regulation, including obligations for AI developers and users, to minimise risks and ensure the ethical use of AI. Finally, the paper will focus on whether the AI Act effectively ensures the protection of users in the context of AI.

This article discusses the privacy issues surrounding the DeepSeek AI system, which is facing allegations of transferring user data to China. The author analyses the legal framework for data protection in the EU, in particular with regard to the GDPR and the AI Act, and assesses whether DeepSeek complies with the requirements of these regulations. The study also reflects on the European Union’s approach to AI regulation and the application of the precautionary principle, which has been used in the past, for example, to restrict access to certain digital services in Europe. The paper also compares the EU and US approach to technology companies based in China, highlighting the similar case of ByteDance, TikTok’s parent company, which faced allegations of data sharing with Chinese authorities. The author assesses possible regulatory scenarios for DeepSeek, including security threat listing, temporary banning or permanent blocking of its services in the EU. Particular attention is paid to the question of proportionality and effectiveness of these measures, both in terms of data protection and geopolitical implications. The study concludes that, although the EU emphasises dialogue and redress, if there are reasonable doubts about data security, it would be appropriate to temporarily restrict DeepSeek’s operations until it demonstrates full compliance with European legal standards.

Výzkum analyzuje právní rámec ochrany osobních údajů v EU, zejména s ohledem na nařízení GDPR a AI Act, a hodnotí, zda DeepSeek splňuje požadavky těchto regulací.

The article analyzes both the normative and practical shortcomings in the protection of individuals when automated decision-making is used in EU law, focusing on Article 22 GDPR and Article 86 of the Artificial Intelligence Act. It examines the scope and limits of the rights to an explanation, human intervention, expression of his/her points, and contesting a decision – not only on the basis of statutory provisions themselves, but also in the context of CJEU case law. The article addresses preparatory and auxiliary automated acts that effectively determine the final outcome without falling under a special-protection regime. It further criticizes the exclusion of legal persons from these rights despite the significant impacts of automated decision-making in areas such as creditworthiness assessment or market access, as well as the uncertainties related to the allocation of responsibilities between controllers and processors and to the categorization of AI systems. In conclusion, the article argues for a material, impact-based understanding of decisions subject to special protection and for strengthening the right to an explanation across AI system risk categories.

Artificial intelligence permeates all areas of our lives, and law is no exception. AI-based systems can be used both for formulating rules of behavior (i.e. in lawmaking) as well as for deciding whether those rules have been respected (i.e. in the judiciary). However, such use raises a number of questions given its substantial impact on the life of individuals and society as a whole. Therefore, the aim of this article is to identify in general the possible problems and opportunities in the use of AI in the field of law and judicial decision-making. The article briefly maps the current approaches and trends in the use of these systems in the world and in the Czech Republic. In the field of lawmaking, the main positive contribution is the capability of the technology to assist lawmakers in ensuring that legal norms are logical, systematic and clear. On the other hand, potential risks include automated misinterpretation of deliberately vague legal concepts or incorrect responses of a system to existing gaps in the law. In the field of justice, it appears that AI systems can have a positive impact on the speed and efficiency of court proceedings and therefore on the administration of justice. On the other hand, the use of AI in the judiciary must be used with caution and under supervision to ensure that fairness and the rights of the parties are respected. When using AI systems for the purposes of lawmaking, judicial decision-making and, ultimately, law enforcement by public authorities, it is important to bear in mind potential synergies. Specialized systems used in different sectors by public authorities may interact with each other and cause unforeseen consequences for the entire legal system. This could also lead to a situation in which these systems become to a certain degree a lawmaker, a judge, and an enforcer at the same time. This would be fundamentally at odds with the constitutional principle of separation of powers on which our democratic legal system is built.

Umělá inteligence proniká do všech oblastí našich životů a ani právo není výjimkou.

The utilization of artificial intelligence brings both advantages and risks, placing it at the forefront of interest for regulation at both state and multinational levels. At the European Union level, a regulation addressing artificial intelligence was adopted with the aim of eliminating risks associated with the use of artificial intelligence. However, this regulation does not guarantee complete protection against potential damages. According to current liability legal norms, the specific traits of artificial intelligence can hinder or even prevent affected individuals from claiming compensation for their damages. Consequently, the European Commission has presented a directive proposal on liability for artificial intelligence and a revised directive proposal on liability for defective products. The common objective of both proposals is to ensure effective compensation for affected individuals and to enhance legal certainty for legal subjects in cases involving artificial intelligence. This article evaluates whether these directives can achieve its objectives within the context of the specific traits of artificial intelligence, which present new challenges to traditional legal frameworks. The introductory section presents the topic and prior EU initiatives in this field. This is followed by an analysis of the directives, their scopes, differences, and some of their shortcomings. Special attention is paid to tools intended to contribute to the stated objectives, namely rules for disclosure of evidence and rebuttable legal presumptions. The concluding chapter summarizes crucial findings, identifies shortcomings in the legislation, and offers potential changes to improve goals attainment.

Společným cílem obou návrhů je zajištění účinného odškodnění poškozených osob a přispění k právní jistotě subjektů práva v případech zahrnujících umělou inteligenci.

Hybrid IT systems with biological brains (hybrots) enhance our understanding of brain functioning. However, given their specific form of existence and their ability to act autonomously to a certain degree, they raise questions regarding attributing liability in case they cause damage. The aim of this paper is to suggest a scheme for attributing liability to these systems while taking into account liability issues related to artificial intelligence. Firstly, the paper describes the technology of hybrid systems, its history, state of the art as well as its technological constraints. Next, general social and ethical aspects of the technology are briefly described. Finally, the paper describes the main problems related to liability of hybrid systems and sets out criteria for determining liability for damages caused by hybrots.

Contemporary history research in the digital age is increasingly dominated by digital sources. The study of these data requires not only different critical approaches for their examination, but also new competences on the part of historians of contemporary history, especially in terms of advanced user skills in the field of information technology. Since the end of the 1990s, this issue has been intensively addressed by the so-called digital history, which focuses on working with digitized or exclusively digital sources in hybrid research of the (not only recent) past. In his overview study, Hlaváček introduces digital history as a relatively young (sub)- discipline of historiography, summarizes its development to date, and outlines its basic theoretical and methodological background and concepts, including current trends, the rapid development of artificial intelligence tools, and possible future implications for historians. He concludes by highlighting the transformation of historical research methods in the context of the twenty-first century and the need to combine classical and digital approaches to achieve more comprehensive results. He notes that while in some Western countries the issue has already received relatively systematic institutional and research attention, in Czech historiography the reflection on issues related to digital history as well as the acquisition of relevant professional competences is still at the very early stages.

Developments in information technology and artificial intelligence are providing tools that have considerable potential to facilitate and enrich research in the fields of history and related sciences. A prerequisite for their effective use, however, is the most perfect conversion of analogue historical sources into machine-readable form, so that the search, classification and extraction of the information contained in them is as efficient as in born-digital sources. In their study, Kykal and Fišer first provide an overview of the development of digital libraries and the making available of the results of digitization in the Czech Republic, taking into account the different strategies and technological backgrounds of libraries and archives. They reflect on the limitations of full-text search and point out a surprising systemic deficit in current digital libraries, namely the absence of the diagnostics of the quality of machine transcription performed by Optical Character Recognition (OCR) programs. They then pay special attention to presenting the parameters and possibilities of the Digital Reading Room of the Ministry of Defence of the Czech Republic (Digitální studovna Ministerstva obrany ČR, DSMO), which is based on the Kramerius Digital Library system. Thanks to its role as an aggregator of the digitization production of the memory institutions of the Ministry of Defence, the Reading Room makes available both library documents and digitized items from archive collections and museum collections. Using the example of a printed periodical of the Austro-Hungarian Army from the First World War, the process of the additional enhancement of OCR results using the PERO tool (Czech abbreviation for pokročilá extrakce a rozpoznávání obsahu - Advanced Extraction and Recognition of Content) is presented, including enrichment with a metadata scheme which captures the layout of graphic and text objects (Analysed Layout and Text Objects, ALTO) and allows the precise localization of the searched text on the digitized image. Using this program, the textual content of not only printed or typewritten texts, but also handwritten texts, can be retrieved much more efficiently and with noticeably higher quality. Moreover, the data in the ALTO scheme could be used to automatically monitor the quality of OCR results. This procedure would significantly increase the usability of semantic search, machine translation, summarization and many other artificial intelligence tools that are yet to be fully deployed in the Czech Digital Library environment.
